negotiated. <br /> When an item of work for which a lump sum price is shown in <br /> the proposal is added or omitted by the issuance of a change <br /> order , the adjustment in the contract amount shall be the lump <br /> sum bid price for the item of work being added or omitted , <br /> ' providing the sum total amount of all such added or omitted <br /> items of work does not exceed 158 of the original contract <br /> amount. If the sum total amount of all such added or omitted <br /> items of work exceeds 158 of the original contract amount , the <br /> adjustment in the contract amount will be negotiated. <br /> Adjustments , if any, in the amount to be paid the Contractor <br /> by reason of any other modifications of the work as set forth <br /> in a contract change order, shall be determined by one or more <br /> of the following methods: <br /> a. Lump Sum Price - By an acceptable lump-sum proposal from <br /> the Contractor . The Contractor ' s proposal shall provide <br /> to the satisfaction of the Engineer , a detailed breakdown <br /> of materials , equipment and labor and show the <br /> Contractor ' s allowance for overhead, profit , and all <br /> other expenses. <br /> b. Unit prices - By unit prices fixed by agreement between <br /> the Agency and the Contractor. <br /> C. Force Account - Whenever the Contractor is directed to do <br /> the extra work on the time and expense basis, he shall <br /> keep an accurate daily record in a manner acceptable to <br /> the Engineer of all the actual and necessary expenses <br /> pertaining to the extra work and shall make such records <br /> available to the Engineer for inspection at all times. <br /> Payment shall be on the basis of the actual necessary <br /> expense for doing the extra work plus an allowance of 158 <br /> for labor , materials and equipment rental for overhead, <br /> general superintendence and profits plus one percent for <br /> bond . When the work is done by a subcontractor , the <br /> Contractor may add five percent to the subcontractor ' s <br /> proposal for overhead and profit and one percent for <br /> bond. <br /> For the purpose of this article , " actual necessary <br /> expense" shall mean the sum of the following items and <br /> all such costs whether incurred by the Contractor , a <br /> subcontractor , or others. <br /> 1 (1) Materials and equipment furnished by the Contractor <br /> and nessarily used in the work shall include <br /> applicable taxes and discounts whether taken by the <br /> purchaser or not. <br /> G-39 <br />
