(AGE) is requesting approval <br /> bythe San Joaquin County Environmental Health Department(SJCEHD)for areduction in sampling <br /> frequency of ground water monitoring wells at 2353 Toste Road, Tracy, California (site). <br /> The environmental cleanup at the site is funded through a claim with the State of California <br /> Underground Storage Tank Cleanup Fund (USTCF). As SJCEHD may be aware, the USTCF has <br /> suspended Mr. Toste's claim until further notice because of funding and management issues. <br /> Reimbursement requests for Mr. Toste totaling over $12,000 are presently in suspension at the <br /> USTCF. The USTCF has notified all claimants payment of reimbursement requests are delayed <br /> beyond"historical time periods".It is unlikely Mr.Toste will receive any reimbursement monies for <br /> up to 30 months.Based on the estimate of 30 months for reimbursement,it is unlikely Mr.Toste will <br /> receive any type of reimbursement from the UST Cleanup Fund before April 2011. <br /> In an attempt to resume funding from the USTCF, Mr. Toste is presently completing required <br /> documentation to request reassignment from Priority Class "C"to Priority Class "B". However, it <br /> is our understanding the process,which included a Fund Manager's Decision,can take 6 months or <br /> more for approval. <br /> It is Mr. Toste's desire to remain in compliance with appropriate environmental directives and <br /> continue the approved ground water remediation. However, the status of USTCF reimbursements <br /> and the current fiscal crisis are creating a severe hardship.On behalf of Mr.Taste,AGE is proposing <br /> the following: <br /> • Continued operation of the site's ozone injection remediation system with injection limited <br /> to shallow ozone injection points surrounding impacted well MW-7 (0-1 and 0-5) and <br /> 837 Shaw Road, Stockton.California 95215 <br /> Telephone (209) 467-1006 Fax (209)467-1 1 18 <br />
