CHAPTER 13 . QUARRY EXCAVATION PERMITS - SECTION 9-2240 . INTENT . It is the intent of this Chapter to provide for the conservation and wise use of mineral resources while protecting people , property , and the environment from hazards caused by excavations . It is recognized that the excava- tion of mineral resources is necessary to implement the General Plan, and that known deposits must , therefore , be protected. In order to protect mineral resources , the County will encourage their identification and protection until they can be harvested. It is further recognized that excavations can create hazards, create nuisances , damage property , and adversely affect the environment . Therefore , the location of excavations will be controlled, operations will be subject to conditions , and rehabil- itation of excavation sites will be required. Through conser- vation and the uniform application of minimum conditions, it is intended to keep the cost of extractive materials as low as possible without jeopardizing the broader public interest . The establishment of conditions to guide the review of Quarry Excavation Permit applications does not preclude the right of the Planning Commission or Board of Supervisors to deny an applica- tion which poses a threat to the public ' s health , safety, or welfare or may harm the agricultural capability of adjoining pro- perties . Source: Ordinance No . 1866 , 3012 , 3110 . SECTION 9-2241 . PERMITTED ZONES . Quarry Excavation Permit applications may be accepted in the following zones and under the specified conditions : (a ) M-1 zone; ( b ) M-2 zone; ( c ) AG zone if : ( 1) The United States Soils Conservation Service soil classification for that portion of the property to be excavated is neither Prime Farmland, Farmland of Statewide Significance nor Unique Farmland or ; ( 2 ) That portion of the property to be excavated contains substantial deposits of mineral resources or a por- tion of a deposit of substantial mineral resources , as herein defined and the materials listed in that definition are actually manufactured from the mineral resources extracted. Substantial deposit shall mean _ a deposit of mineral resources with a minimum gross selling price value of at least five million dollars ( $5 , 000 , 000 ) in 1978 equivalent dollars at the plant site .
