CHAPTER 13 . QUARRY EXCAVATION PERMITS - <br /> SECTION 9-2240 . INTENT . It is the intent of this Chapter <br /> to provide for the conservation and wise use of mineral resources <br /> while protecting people , property , and the environment from <br /> hazards caused by excavations . It is recognized that the excava- <br /> tion of mineral resources is necessary to implement the General <br /> Plan, and that known deposits must , therefore , be protected. In <br /> order to protect mineral resources , the County will encourage <br /> their identification and protection until they can be harvested. <br /> It is further recognized that excavations can create hazards, <br /> create nuisances , damage property , and adversely affect the <br /> environment . Therefore , the location of excavations will be <br /> controlled, operations will be subject to conditions , and rehabil- <br /> itation of excavation sites will be required. Through conser- <br /> vation and the uniform application of minimum conditions, it is <br /> intended to keep the cost of extractive materials as low as <br /> possible without jeopardizing the broader public interest . The <br /> establishment of conditions to guide the review of Quarry <br /> Excavation Permit applications does not preclude the right of the <br /> Planning Commission or Board of Supervisors to deny an applica- <br /> tion which poses a threat to the public ' s health , safety, or <br /> welfare or may harm the agricultural capability of adjoining pro- <br /> perties . <br /> Source: Ordinance No . 1866 , 3012 , 3110 . <br /> SECTION 9-2241 . PERMITTED ZONES . Quarry Excavation Permit <br /> applications may be accepted in the following zones and under the <br /> specified conditions : <br /> (a ) M-1 zone; <br /> ( b ) M-2 zone; <br /> ( c ) AG zone if : <br /> ( 1) The United States Soils Conservation Service soil <br /> classification for that portion of the property to be <br /> excavated is neither Prime Farmland, Farmland of <br /> Statewide Significance nor Unique Farmland or ; <br /> ( 2 ) That portion of the property to be excavated contains <br /> substantial deposits of mineral resources or a por- <br /> tion of a deposit of substantial mineral resources , <br /> as herein defined and the materials listed in that <br /> definition are actually manufactured from the mineral <br /> resources extracted. Substantial deposit shall mean <br /> _ a deposit of mineral resources with a minimum gross <br /> selling price value of at least five million dollars <br /> ( $5 , 000 , 000 ) in 1978 equivalent dollars at the plant <br /> site . <br /> Source: Ordinance No . 1866 , 3012 , 3474 . <br /> 2 . 29 Revised 5/26/89 <br />
