APPEAL OF LESTER AND ROBERTA RAINES <br /> QUARRY EXCAVATION APPLICATION NO. QX-90-1 <br /> OF CLAUDE C. WOOD CO. <br /> additional acoustical analysis before starting to excavate. <br /> That analysis will be prepared by a qualified acoustical <br /> engineer and will verify the location of the project' s sixty- <br /> five db Ldn noise contour and develop appropriate mitigation <br /> for compliance with the Planning Title's Noise Ordinance. <br /> Should actual noise levels on adjacent properties reach the <br /> maximum allowable levels, the applicant must implement <br /> specific mitigations to reduce the noise levels back to <br /> acceptable levels. <br /> 3 . Appeal Statement: <br /> The appellant states that smoke, vehicle exhausts and fumes <br /> from the project will rise above the bluff and be carried by <br /> the prevailing westerly winds into Clements, resulting in an <br /> adverse effect on local residents. <br /> Response⢠<br /> In addition to the mitigation measures outlined above in the <br /> response to appeal statement number one, the applicant is <br /> required to maintain Permits to Operate from the Air Pollution <br /> Control District. The existing operation's permits cover over <br /> twenty conditions for operation that are inspected for <br /> compliance by the APCD on a quarterly basis. <br /> 4. Appeal Statement: <br /> "Existing wildlife will be driven from the area because of <br /> change of terrain, noise, dust, exhaust and gas and diesel <br /> fumes. Material, besides water, to help dust problems, <br /> sterilizes the ground and would leach into the river, killing <br /> fish and vegetation. " <br /> Response⢠<br /> The project's extraction area is located on a portion of the <br /> parcel that is currently under agricultural use. As such, the <br /> quarry is not expected to have a significant effect on either <br /> plant or animal species in this area. The location of the <br /> haul route and bridge used for transporting excavation <br /> material to the processing plant was identified as having the <br /> potential to result in adverse impacts on the river <br /> environment. The EIR identified specific mitigation measures <br /> to reduce those potential impacts to less than significant <br /> levels. Those mitigation measures were adopted by the <br /> BOS LETTER PAGE 3 <br />
