APPEAL OF LESTER AND ROBERTA RAINES <br /> QUARRY EXCAVATION APPLICATION NO. QX-90-1 <br /> OF CLAUDE C. WOOD CO. <br /> Mokelumne River and its habitat, dust, noise, project components, <br /> the significance of potential environmental impacts, and the <br /> appropriateness of identified mitigation measures. After <br /> considering all written and oral testimony, the Commission voted <br /> 6-0 to approve Quarry Excavation Application No. QX-90-1. <br /> on September 17, 1990, Lester and Roberta Raines filed an appeal of <br /> the Planning Commission's approval of the application, based upon <br /> the project's upland impacts on residents in the town of Clements. <br /> 1. Appeal Statement: <br /> The appellants state that there was a lack of full consider- <br /> ation by the Planning Commission of the effects the quarry <br /> would have on the town of Clements, its property owners and <br /> residents in the area. A specific complaint was that the <br /> adopted dust mitigation measures were inadequate because the <br /> quarry would result in more dust than is currently generated <br /> by farming activities. <br /> Response: <br /> The dust mitigation measures identified by the EIR were found <br /> to be adequate to reduce potential impacts to less than <br /> significant levels. The mitigations - including the required <br /> application of water or other dust suppressants to working <br /> surfaces and service roads, restrictions on vehicle speeds, <br /> preparation of a dust control plan, and conformance with the <br /> Air Pollution Control District' s (APCD) Regulation VIII for <br /> dust control - were required by the Planning Commission as <br /> Conditions of Approval for the Quarry Excavation Permit. <br /> Ongoing monitoring by APCD and Planning Division staff will <br /> ensure compliance with the adopted conditions. <br /> 2 . Appeal Statement: <br /> The appellants state that "the constant noise" that would be <br /> generated by the quarry's 6: 00 a.m. to 6: 00 p.m. operation is <br /> unacceptable. <br /> Response: <br /> In order to ensure that noise levels associated with this <br /> project do not exceed maximum allowable levels (see Section <br /> 9-3800 (b) of the Planning Title) , the applicant has been <br /> required through the Conditions of Approval to conduct <br /> BOS LETTER PAGE 2 <br />
