Staff Report • • -7- <br /> R. Lawson Enterprises, LLC dba WildRose Vineyards <br /> numerous violations of the wastewater application requirements and failure to construct required <br /> improvements to the wastewater treatment system. The Discharger has never complied with the <br /> monitoring and reporting program. <br /> Degree of Culpability <br /> The Discharger is culpable for the violation cited as it had received verbal and written <br /> notifications regarding the necessity to operate the wastewater treatment system in accordance <br /> with the WDRs. The Discharger had ample opportunity to submit the required reports, or <br /> discuss with staff any problems they were encountering in meeting the prescribed deadlines, but <br /> failed to do so. <br /> Economic Benefits <br /> By failing to submit the required technical reports and monitoring reports, the Discharger <br /> realized an economic benefit by delaying the expenditure of funds necessary to fully assess the <br /> impacts on water quality from this particular discharge of waste. <br /> Other Matters as Justice May Require <br /> Staff costs associated with the generation of the ACLC, agenda material, and the Regional Board <br /> presentation are estimated to be eight thousand dollars ($8,000). <br /> DETERMINATION OF AMOUNT <br /> Water Code Section 13268 authorizes the imposition of administrative civil liability for violation <br /> of Water Code Section 13267. The maximum fine for each day of violation is one thousand <br /> dollars ($1,000). On 7 December 2001,the date the ACLC public hearing has been scheduled, <br /> the total number of days that reports are late is 4,342 days. Therefore, the total maximum <br /> administrative civil liability amount available to the Executive Officer for the violations noted in <br /> the Complaint is four million,three hundred forty two thousand dollars ($4,342,000). <br /> The Executive Officer proposed that Administrative Civil Liability be imposed in the amount of <br /> twenty-five thousand dollars ($25,000). <br /> RECOMMENDATION <br /> Staff recommends that the Regional Board adopt the proposed Administrative Civil Liability <br /> Order in the amount of$25,000. <br />
