CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> ACL ORDER NO. <br /> ADMINISTRATIVE CIVIL LIABILITY ORDER <br /> IN THE MATTER OF <br /> R. LAWSON ENTERPRISES, LLC dba WILDROSE VINEYARDS <br /> SAN JOAQUIN COUNTY <br /> This Order for Administrative Civil Liability(hereafter Order) is issued to R. Lawson Enterprises, LLC <br /> dba WildRose Vineyards (hereafter Discharger) based on a finding of failure to submit reports pursuant <br /> to California Water Code Section 13267, and based on Provisions of the California Water Code Section <br /> 13267(b)(1) and Sections 13268(a) and(b), which authorize the imposition of an Administrative Civil <br /> Liability. <br /> The California Regional Water Quality Control Board, Central Valley Region, (hereafter Board) finds, <br /> with respect to the Discharger's acts, or failure to act, the following: <br /> 1. R. Lawson Enterprises, LLC operates a winery and related wastewater treatment and disposal <br /> system at 8751 E. Highway 12, Victor in San Joaquin County. The facility(Assessor's Parcel <br /> Nos. 051-060-02, 03, 04,40, 41, and 051-030-50, 51, 59, 63) is located in Section 4, T3N, R7E <br /> MD&M. <br /> 2. Wastewater treatment at the facility consists of a two-stage wastewater sump and a screen, <br /> followed by disposal to 9.2 acres of cropped application area. An additional 4.6 acres of fallow <br /> land could be made available for wastewater application by planting crops. Waste Discharge <br /> Requirements (WDRs) No. 5-00-182 prescribes requirements for the discharge. <br /> 3. In 1999, the Discharger constructed the winery and was granted a one-year waiver of WDRs in <br /> order to monitor its wastewater quality and prepare a Report of Waste Discharge. However, the <br /> Discharger failed to collect the wastewater quality data as required by the waiver. <br /> 4. On 4 August 2000, the Board adopted WDRs No. 5-00-182, which allows for land application of <br /> up to 5,000 gallons of winery wastewater per day from the facility. The Discharger was required <br /> to submit reports documenting the installation of flow meters and storage tanks, separation of <br /> wastewater, installation of groundwater monitoring wells, and preparation of an Operation and <br /> Maintenance Plan. These reports were required pursuant to Section 13267 of the California Water <br /> Code. <br /> 5. The Discharger has not submitted any complete technical reports required by the WDRs <br /> Provisions. In addition, the Discharger has submitted only three of the 12 self-monitoring reports <br /> required to date. The following technical reports were required to be submitted: <br /> Technical Report Due Date <br /> Report describing the installation of <br /> -Winery wastewater flow meter 6 October 2000 <br /> -Separation of stormwater flows <br /> -Installation of the 12,000 gallon tank <br />
