City of Escalon 4 24 September 2014 <br /> San Joaquin County <br /> the Stanislaus River violates the following Prohibitions and Discharge Specifications of WDRs <br /> Order 5-00-142: <br /> • Prohibition A.1 <br /> • Prohibition A.2 <br /> • Discharge Specification B. 6 <br /> • Discharge Specification B.8, and <br /> • Discharge Specification B. 11. <br /> The presence of WWTF derived odors in the Del Rio subdivision violates Discharge <br /> Specification B.6 of WDRs Order 5-00-142. <br /> Corrective Actions: <br /> As previously stated in Regional Board staff's 19 September 2014 electronic mail (e-mail), the <br /> current situation exposes the City to monetary penalties for failure to comply with the WDRs, as <br /> well as other applicable regulations. A failure of the berms would be a catastrophic, unpermitted <br /> discharge of wastewater to the Stanislaus River and an extremely serious violation of the <br /> WDRs, the California Water Code and the Clean Water Act. As a result, the City would be <br /> exposed to even more significant monetary penalties than it currently faces. Therefore, the City <br /> must take all steps necessary to prevent another spill to the Stanislaus River. <br /> In addition, the Regional Board immediately informed the City by e-mail of actions necessary to <br /> gather information regarding the WWTF facility operations. The e-mail stated the following- <br /> 1. <br /> ollowing:1. Beginning September 20th the City shall implement daily monitoring of influent flow, <br /> pond freeboard, and berm inspections. E-mails shall be submitted, each day with the <br /> results of the monitoring. <br /> 2. By 25 September 2014, the City shall submit the name of the professional engineer or <br /> geotechnical engineer which the City has retained to evaluate the conditions of the <br /> wastewater pond berms and make recommendations as to repairs or other actions <br /> necessary to preclude the possibility of berm failures. <br /> 3. By 25 September 2014, the City shall submit daily influent flow and freeboard logs for <br /> July through September 2014. <br /> Furthermore, by 31 October 2014, the City shall submit a report prepared by a California <br /> Licensed Engineer or Geologist that contains the following: <br /> 1. An evaluation of domestic and industrial influent flows into the wastewater treatment <br /> facility for the 2013 and 2014 processing season. The evaluation shall include (a) <br /> review of flow meter calibration records and daily flow logs for the wastewater treatment <br /> facility, Escalon Premier Brands and Eckert Cold Storage and (b) evaluate the flow <br /> monitoring systems ability to accurately record wastewater flows. The report shall <br /> identify any flow monitoring and reporting discrepancies or flow violations, and evaluate <br /> factors that caused the freeboard/capacity violations of Order 5-00-142. <br /> 2. An evaluation of the wastewater pond system berms and a water balance demonstrating <br /> whether or not the ponds have adequate storage and disposal capacity. The report shall <br />
