The Department, pursuant to Section 2.5159.6 of the Health and Safety <br /> 2 Code, administers and enforces the standards and regulations adopted pursuant. <br /> 3 to the California Hazardous Waste Control Act (the "Act") and the Federal <br /> 4 Resource Conservation and Recovery Act (RCRA) , 42 U.S.C. 6901 et seq. <br /> 5 'i 3. Section 25187 of the Health and Safety Code authorizes the Department <br /> 6 to issue an order specifying a schedule of compliance or correction whenever <br /> 7the Director determines, after public hearing, that any person has violated or <br /> 8 is in violation of any provision of the Act. An order issued pursuant to <br /> 9 Section 25187 may include: a requirement that such person take corrective <br /> I <br /> 10 action; and a schedule for compliance including the cleanup of such hazardous <br /> 11 waste, abatement of the effects thereof, and any other necessary remedial <br /> 12 action. <br /> 13 III <br /> 14 FINDINGS OF FACT <br /> 15 1 . Respondent owns and operates a facility located at 110 East Turner <br /> 16 Road, Lodi, California (hereinafter the Facility). <br /> 17 2. Respondent manufactures custom nameplates at the Facility. Nameplates <br /> 18 are produced from aluminum sheets utilizing a process called anodizing. <br /> 19.1 3. On May 17, 1982, and on August 29, 1984, the Department inspected the <br /> 20 Facility to determine compliance with the Act. As a result of those <br /> I <br /> 21 inspections, the Department has determined that Respondent produces, treats, <br /> II <br /> 2211 stores and disposes of hazardous wastes at the Facility within the meaning of <br /> 23 Sections of 25113, 25120, 25123 and 25123.5 of the Health and Safety Code. <br /> 24 <br /> 25 <br /> 26 <br /> 27; <br /> COLBTP.... j <br /> STATCOF CA LI FOP......... <br /> OP....
