1 4. The Department's inspections disclosed the following facts: <br /> 2 a. Respondent generates hazardous wastes at the Facility, including <br /> 3 waste solvents, caustic soda, alcohols and distillation residues. Respondent <br /> 4 disposes of the still bottom residues by spreading the waste on the Facility <br /> 5 perking lot. <br /> i <br /> 6 b. A still bottom residue sample collected by the Department during <br /> I <br /> 7 the inspection conducted on May 17, 1982 contained toluene, acetone, and 1 <br /> 1 <br /> 8 diacetone alcohol. This sample was found to be flammable with a flash point of <br /> 9 less than 70 degrees Fahrenheit. This sample was determined to be a hazardous <br /> to waste under Section 25117 of the Health and Safety Code. I <br /> 11 C. The Facility was inspected again by the Department on j <br /> L2 August 29, 1984. Another still bottom sample was taken. Analysis of this <br /> 13 sample showed that it contained 1 ,1 ,1 trichlorethane, acetone, and other <br /> i <br /> 14 organic materials which are hazardous waste as defined by Section 2.5117 of the <br /> 15 Health and Safety Code. <br /> 16 <br /> d. From 1971 through 1979, Respondent used an underground concrete- <br /> 17 lined bunker to store caustic sodas, spent solvents, and alcohols. In July of <br /> 18 1979, Respondent illegally discharged an estimated 15,000 - 20,000 gallons of <br /> 19 waste to the sewer via a portable pump. This discharge destroyed two digesters j <br /> 20 at the Lodi city treatment plant. Respondent paid $1 ,200 - $1 ,300 to repair <br /> 21 the digesters. <br /> 22 - e. Since 1979, the Respondent has disposed of its liquid <br /> i <br /> 23 hazardous wastes in the following manner: by discharging untreated waste to i <br /> 24 , the city sewer system; by shipping wastes to Romic Chemical Corporation; and by <br /> 25 refilling the storage bunker. <br /> 26 <br /> 27 <br /> -3- <br /> COURT PAPER <br /> STATE Or CRLIF...IA <br /> STo. 113 IaeV. a <br /> E 32915 <br />
