,%Woe SM04 <br /> Pg 2 <br /> Chronology: Port Rd. 21 & M SITE CODE: 1237 <br /> 05/24/88 SJLHD received letter opinion from District's <br /> attorney, Al Hoslett. Mr. Hoslett stated that <br /> when the Bank of Stockton returned the property to <br /> the Port of Stockton, at a date no later than <br /> 7/17/87, the owner took possession of not only the <br /> real property but also the UST located thereon. <br /> 05/27/88 SJLHD directs correspondence to the Port of <br /> Stockton citing authority under California law for <br /> compliance to the Health and Safety Code <br /> commencing with Section 25280. <br /> 06/08/88 Port of Stockton submits letter disclaiming <br /> ownership and states that they are prepared to <br /> initate legal action against the Health District <br /> to declare legal obligation of the parties to <br /> ensure that the District takes appropriate and <br /> legal action with respect to the Energy Petroleum <br /> site and other sites within the Port' s property. <br /> Lisa Brown, attorney of San Joaquin County <br /> District Attorney' s office, contacted SJLHD <br /> regarding a complaint from the Port of Stockton to <br /> the Regional Water Quality Control Board. The <br /> Port has complained that the District has not <br /> properly handled the situation. Copies of <br /> correspondence were provided to Mr. Brown. <br /> 07/19/88 SJLHD received copy of the Port's response to <br /> Deputy District Attorney Lisa Brown' s letter of <br /> 7/8/88 . The Port is soliciting assistance with <br /> another tenant problem prior to assisting in <br /> resolving the Energy Petroleum UST problem. <br /> 08/01/88 SJLHD received a copy of the Port ' s letter to Lisa <br /> Brown citing statue law that all parties involved <br /> should be made to bear the responsibility for the <br /> UST abandonment. <br /> 08/18/88 Deputy District Attorney, Lisa Brown corresponds <br /> with SJLHD regarding the Port ' s July 29, 1988 <br /> letter; specifically, Mr. MacDonald' s request to <br /> order all parties to perform the removal. <br /> 10/03/88 SJLHD met with District' s attorney, Al Hoslett and <br /> San Joaquin County Deputy District Attorney, Lisa <br /> Brown to discuss status of the Port of Stockton. <br /> 10/26/88 SJLHD drafted letter to Port of Stockton <br /> scheduling an administrative office hearing to <br /> discuss disposition of USTs. <br />
