"two SW Chronology: Port Road 21 & M SITE CODE: 1237 01/22/86 Energy Petroleum, Inc. submitted registration fees to San Joaquin Local Health District (SJLHD) for 4 UST's (underground stroage tank) . 08/13/86 SJLHD conducted Site evaluation. 07/27/87 Mark Meckler, Attorney representing The Port of Stockton notified SJLHD that Pete Smith and Energy Petroleum have filed bankruptcy. Mr. Meckler requested SJLHD order Energy Petroleum to remove the UST. 08/11/87 SJLHD received bankruptcy court documents. 08/14/87 The Port of Stockton' s attorney writes letter stating the Port will take no action to assume responsibility for the UST' s. 02/18/88 SJLHD receives returned billing statement. Unable to deliver due to post office box closure. 03/02/88 Mark Tollini, Port of Stockton representative, discussed with SJLHD staff the number and location of UST for the purpose of compliance. 03/03/88 SJLHD received letter from Bank of Stockton denying ownership of UST' s. 03/07/88 SJLHD staff met at the site with Mike Trent, Port of Stockton representative for the purpose of evaluating the number and location of UST. 03/09/88 Site Inspection report of 3/7/88 mailed to Port of Stockton. 03/15/88 SJLHD receives letter from Port of Stockton contesting the fact of being named as owner of the site in question. 03/22/88 SJLHD contacted Bank of Stockton regarding the UST yearly fees for compliance. Mr. John Urrutia stated the bank held no interest in the permanent fixtures. SJLHD was referred to Bank of Stockton attorney, Bill Parrish. 03/24/88 Mr. Parrish, Bank of Stockton's attorney, stated the bank did not have ownership in the UST and that a letter was mailed to the Port of Stockton's attorney, Steve MacDonald indicating this fact. 05/03/88 SJLHD received letter from Port of Stockton regarding continued billing statements. The letter states the Port has no legal responsibility to obtain or pay for any permit to operate.
