"two SW <br /> Chronology: Port Road 21 & M SITE CODE: 1237 <br /> 01/22/86 Energy Petroleum, Inc. submitted registration fees <br /> to San Joaquin Local Health District (SJLHD) for 4 <br /> UST's (underground stroage tank) . <br /> 08/13/86 SJLHD conducted Site evaluation. <br /> 07/27/87 Mark Meckler, Attorney representing The Port of <br /> Stockton notified SJLHD that Pete Smith and Energy <br /> Petroleum have filed bankruptcy. Mr. Meckler <br /> requested SJLHD order Energy Petroleum to remove <br /> the UST. <br /> 08/11/87 SJLHD received bankruptcy court documents. <br /> 08/14/87 The Port of Stockton' s attorney writes letter <br /> stating the Port will take no action to assume <br /> responsibility for the UST' s. <br /> 02/18/88 SJLHD receives returned billing statement. Unable <br /> to deliver due to post office box closure. <br /> 03/02/88 Mark Tollini, Port of Stockton representative, <br /> discussed with SJLHD staff the number and location <br /> of UST for the purpose of compliance. <br /> 03/03/88 SJLHD received letter from Bank of Stockton <br /> denying ownership of UST' s. <br /> 03/07/88 SJLHD staff met at the site with Mike Trent, Port <br /> of Stockton representative for the purpose of <br /> evaluating the number and location of UST. <br /> 03/09/88 Site Inspection report of 3/7/88 mailed to Port of <br /> Stockton. <br /> 03/15/88 SJLHD receives letter from Port of Stockton <br /> contesting the fact of being named as owner of the <br /> site in question. <br /> 03/22/88 SJLHD contacted Bank of Stockton regarding the UST <br /> yearly fees for compliance. Mr. John Urrutia <br /> stated the bank held no interest in the permanent <br /> fixtures. SJLHD was referred to Bank of Stockton <br /> attorney, Bill Parrish. <br /> 03/24/88 Mr. Parrish, Bank of Stockton's attorney, stated <br /> the bank did not have ownership in the UST and <br /> that a letter was mailed to the Port of Stockton's <br /> attorney, Steve MacDonald indicating this fact. <br /> 05/03/88 SJLHD received letter from Port of Stockton <br /> regarding continued billing statements. The <br /> letter states the Port has no legal responsibility <br /> to obtain or pay for any permit to operate. <br />
