• Page 2 of 3 <br /> Cc: Akfdevartie@aol.com <br /> Subject: Access to destroy monitoring well <br /> Mr. Dawson, <br /> This email is a follow up to my December 6, 2010 phone call to your office. <br /> The responsible party for the former Spreckles Sugar Plant in Manteca California is in the <br /> process of obtaining a "No Further Action" (NFA) status to the investigation/mitigation <br /> process required of them by the State of California, Regional Water Quality Control <br /> Board-Central Valley Region. Prior to your Manteca California Target store construction, <br /> many monitoring wells were installed by Spreckles over a large area to monitor and <br /> sample the groundwater around the Spreckles Plant. Since then, the Spreckles Plant <br /> has been removed and the property divested. Unfortunatley, not all of the monitoring <br /> wells were destroyed at that time. Now that the investigation and clean up is complete, <br /> the remaining monitoring wells are no longer needed and must be destroyed before the <br /> NFA can be issued. <br /> The San Joaquin County Environmental Health Department (SJCEHD) is the local <br /> agency assigned to oversight well installations and removals in our County. This is <br /> done by the SJCEHD issuing the required permit and witnessing the procedure. <br /> All but monitoring well "MW-2r" have been properly destroyed/addressed towards this <br /> end. The SJCEHD can only issue well destruction permits for parcels under approval by <br /> the landowner. According to the City of Manteca Public Works department, MW-2r is <br /> located just outside of the City property line, on Target property. As such, access to <br /> destroy this well must be granted by the landowner before the SJCEHD can issue a <br /> permit to destroy the well properly. My contact with the Spreckles property responsible <br /> party, Mr. Bing Kirk, has advised me that Target has not responded to multiple requests <br /> to access this well and destroy it. <br /> Please grant AKF Development (Spreckles responsible party) access to destroy this well <br /> under a SJCEHD permit. All costs to properly destroy this well will be handled by AKF, <br /> with NO charges to Target. MW-2r is located south of the store's rear lot, south of the <br /> Target wall of vegetation, and at the extreme edge of your southern property line, <br /> abutting the City sidewalk on Phoenix Road. In the process of destroying this well, NO <br /> obstruction to the public or Target operations will occur. The process will take a few <br /> hours and after the well has been removed/destroyed, there should be NO visible signs <br /> the well was ever there. To repeat, there will no obstruction to Target's operations, no <br /> obstructions/interferrence to the public or their access, and no costs to Target if you grant <br /> access. I strongly urge your cooperation in this manner. <br /> You should also know that under SJCEHD Well Standards and policy, if the responsible <br /> party for the well cannot access the well due to problems with the landowner of the <br /> property the well is on, the landowner (also known as the well owner) could be held <br /> responsible to either sample and submit reports of the groundwater quality to the <br /> SJCEHD and eventually be responsible to destroy the well under a SJCEHD permit and <br /> fees. This means Target may have to sample and report on the well and remove the well <br /> at their expense if you do not allow AKF access to destroy the well now. <br /> The destruction of this well does not have to be a problem for Target or a formal <br /> 12/10/2010 <br />
