LICENSE-AGREEMENT <br /> This License Agreement("License") is made as of this 13th day of April,2007,by and <br /> betvicen Texaco DoNvn%seam Properties,Inc a Dclawarc Corporation,{"Licensor"), and Teichert <br /> Collstiuction ("Licensee"), <br /> RECITALS <br /> I�Mo <br /> A. Licensor owns that certain real property located atm Beecj;nut Avenue in the City <br /> of Tracy, San Joaquin County,California depicted on Exhibit A attached hereto wid incorporated <br /> herein by this reference(the"Property"). <br /> B. Licensee wishes to use those certain portions of the Property indicated on Exhibit A <br /> (collectively,the"Prernises")during the Term hereof(as Mat word is defined in Paragraph 2), for <br /> the purposes of only the following: entering and exiting the Premises, relocating an agreed portioll <br /> of existing fencing on the Property and placement and storage of sQil bids (collectively, the <br /> "Activity"). <br /> C. Licensor agrees to permit Licensee to enter upon mid utilize the Premises to perform <br /> the Activity upon the tenTisand conditions contained herein. <br /> NOW,THEREFORE,in consideration of the promises and mutual covenants, agreerrients <br /> and comlitions hereof,and for other good and valuable consideration, the receipt and sufficiency of <br /> vinic b is hereby acknowledged,the parties hereto agree as follows: <br /> l. The License. Licensor hereby agrees to permit Licensee and their agents,employees <br /> and contractors(collectively, the"Licensed Group")to enter onto the Premises and to perforin the <br /> Activity upon the ternis and conditions contained within this Licease, <br /> 2. The License Tenn. The term of the License contained herein shall be for the period <br /> from 13 April 2007 through 01 June 2007(the"Term'). <br /> 3, Consideration. There shall be no license fee as consideration for the License <br /> granted herein. <br /> 4. Deposit, Reserved. <br /> 5. Conditions of License. Licensee agrees that the following terins,shall be the <br /> conditions of the granting of this License: <br /> Z:� <br /> 5.1, Requirements for Changes to the Fencing include the following* <br /> 5.1.1 Housekeeping, Licensee shall utilize good ficusekeeping practices <br /> in the Premises as shown on Exhibit A.This includes ensuring the <br /> soil bin storage area is free of any extraneous trash and debris <br /> during the duration of the License. <br />
