<br /> service or consumption of alcoholic beverages, fueling of vehicles or of Licensee's

<br /> G. Compliance with Laws.Licensee and the Licensed Group shall comply with all
<br /> laws,statutes,rules,orders,and ordinances,including without limitation all laws related to
<br /> "Contamination"(as hereinafter defined),relating to the Activity to be perfornied at the Premises
<br /> under this License. The word "Contamination," as used herein,shall mean any hazardous or toxic
<br /> material,substance,chemical or waste, contaminant, emission, discharge or pollutant or
<br /> comparable material listed, identified or regulated ptirsuiuit to any federal,state or local law,
<br /> ordinance or regulation which has as a purpose the protection of health,safety or the
<br /> eavirctinient, including but not limited to petroleum or petroleum products or wastes derived
<br /> therefrom.
<br /> 7. ExRqnscs, All costs in connection with the Activity upon the Premises shall beat
<br /> Licensee's sole cost and expense. Licensee shall promptly pay for all labor,equipment, material
<br /> and supervision utilized in the conduct of the Activity on the Premises, and shall keep the Property
<br /> free and clear of all liens imposed by reason of the activities of Licensee and the'Licensed Group,
<br /> and shall provide Licensor with copies of any lion releases.
<br /> S. Indemnification. Licensee shall release,protect, indemnify,defend, and hold
<br /> Licensor,together with its members, their parent,sister,and affiliated companies,and the respective
<br /> employees, officers,directors,representatives, servants and agents thereof and their predecessors
<br /> and successors in interest and assigns(collectively,the "Licensor Group"), free and harmless from
<br /> and against any and all clairns,liability,demands and causes of action of all kinds, including but not
<br /> limited to claims of darnage to or loss of property of Licensor or others, injury, illness or death,
<br /> arising out of or being in any way connected with the performance of Licensee or the Licensed
<br /> Group tinder this License,whether any member of the Licensor Group is alleged or proven to be
<br /> absolutely or strictly liable, or to have breached any duty or warranty(express or implied), except to
<br /> the extent such matters are shown by final judgment to have been caused by the sole negligence or
<br /> willful misconduct of the Licensor Group or any member thereof Tlieiiistirincercqtiiret-neatso.f
<br /> Paragraph 10 shall not be constnied to limit the indenini.fication provided berain; the
<br /> indemnification provided herein shall be effective to the inaximuln extent permitted by applicable
<br /> law, Licensee shall be solely responsible for the defense ofany and all claims, liability,demands
<br /> and causes of action of all kinds against any meniber(s)of the Licensor Group hereunder,including
<br /> without limitation, clainis by any employee of Licensee or any employee of any consultant,
<br /> contractor or subcontractor, even though the claimant may allege willful inisconduct or sole
<br /> negligence on the part of the Licensor Group or any member thereof. The parties hereto agree that
<br /> should any reviewing court or arbitrator determine after final judgment that the extent,scope or
<br /> amount of the indemnity required herein exceeds that which is permitted by t-he applicable law,such
<br /> indemnity shall be construed, interpreted mid enforced so as to preserve the maximum extent,scope
<br /> or amount possible the indemnity which is permitted thereby, The obligations of the
<br /> indeniiii 171 cation ptovision herein shall survive the termination or cancellation of this License_
<br /> 9. Release, Licensee releases the Licensor Group, one and all, from any and all
<br /> claims, debts, liabilities,demands,obligations, costs,expenses,attorneys' fees, actions, and
