All information gathered during the study by Kleinfelder is considered confidential and will be released only upon written authorization from the client or as required by law. California law requires a person to inform the state if a situation is encountered that can be considered an immediate endangerment to the public's health or welfare and/or to the environment. CLIENT RESPONSIBILITIES AND ASSUMPTIONS • Atherton Kirk Development will assist Kleinfelder in obtaining access to the site and owner authorization for the proposed sampling. • Adequate work space and access will be provided. Kleinfelder will attempt to advance soil borings and collect samples at the proposed locations. If the drilling equipment cannot be positioned, alternative drilling locations or sampling methods should be investigated. • The borings are to be drilled with a truck mounted drill rig equipped with hollow stem augers, or sampled using a hand auger and slide hammer. If difficult drilling conditions are encountered, alternative sampling methods may be necessary. • Soil and water generated during the drilling and sampling will be the responsibility of the client. Soil cuttings and steam cleaning water will be left on site. Sampling and analysis of the contained soil and water may be necessary prior to disposal. Disposal or remediation options for the soil and water can be assessed once analytical results have been received. Kleinfelder is prepared to assist the client and to remediate or dispose of stockpiled soil and water, if requested. • This proposal is based on the presumption that Atherton Kirk Development will clearly mark utilities and will provide any and all available survey maps or other data to determine the location of tanks, existing structures, underground utilities and services. 20-3978-01.P02/MP960139 Page 4 of 01996, Kleinfelder, Inc.
