00 <br /> 1 6 . 14 ADDITIONAL ENFORCEMENT ACTIONS <br /> 2 By entering into this Order, the Department does not waive any <br /> 3 further enforcement actions. <br /> 4 6. 15 COMPLIANCE WITH APPLICABLE LAWS <br /> 5 Respondents shall carry out this Order in compliance with all <br /> 6 applicable local, State, and Federal requirements, including, <br /> 7 but not limited to, requirements to obtain permits and to <br /> 8 assure worker safety. <br /> 9 6. 16 GOVERNMENT LIABILITIES <br /> 10 The State of California shall not be liable for any injuries or <br /> 11 damages to persons or property resulting from acts or omissions <br /> 12 by Respondents, their officers, directors, employees, agents, <br /> 13 receivers, trustees, successors, or of any persons, including <br /> 14 but not limited to, firms, corporations, subsidiaries, <br /> 15 contractors, or consultants in carrying out activities pursuant <br /> 16 to this Order, nor shall the State of California be held as <br /> 17 party to any contract entered into by Respondents or its agents <br /> 18 in carrying out activities pursuant to this Order. <br /> 19 6. 17 RESERVATION OF RIGHTS <br /> 20 Nothing in this Order is intended or shall be construed to <br /> 21 limit the rights of any of the parties hereto with respect to <br /> 22 claims arising out of or relating to the deposit or disposal at <br /> 23 any other location of substances removed from the Site. <br /> 24 Nothing in this Order is intended or shall be construed to <br /> 25 limit or preclude the Department from taking any other action <br /> 26 authorized by law to protect the public health and welfare or <br /> 27 the environment and recovering the costs thereof. <br /> COURT PAPER <br /> STATE O!GLIEOAXIA <br /> STO. 113 IREV. 8.72I -30- <br /> 85 31)89 <br />
