The spill occurred on 23 January 2007 due to an accident involving a M&L <br /> Andrade and Sons (Andrade) truck and a Union Pacific Railroad (UPRR) train. The accident <br /> resulted in spilling diesel fuel into the ballast and soil beneath the UPRR tracks at McKinley <br /> Avenue near Industrial Way in Stockton. The spill occurred near a drainage ditch that drains <br /> into the delta, and groundwater beneath the site is expected to be about 40 feet deep. Thus, <br /> the groundwater quality and beneficial uses (BUs) of the state's waters are threatened at the <br /> site, specifically the BU of the groundwater for water supply. <br /> The driver of the truck was cited for illegally going through the railroad crossing and Andrade is <br /> responsible to clean up the spilled fuel. However, the spill occurred on UPRR right of way, <br /> therefore UPRR is also responsible to assure that pollutants are not discharged from their <br /> property to the waters of the State. Therefore, the Regional Water Board expects full <br /> cooperation between Andrade and UPRR to investigate and mitigate any threat to water quality <br /> from this spill. <br /> Because the spill occurred about 20 months ago, an initial work plan to investigate how far the <br /> fuel has migrated in the soil and ballast must be submitted to the Regional Water Board.
