UP-88-16 OF ROBERT RONYAK <br /> ----------------------------------------------------------------- <br /> On September 15 , 1988 , the Planning Commission held a public <br /> hearing on Mr . Ronyak' s Use Permit application for a cattle <br /> feedlot and a soil amendment operation. Upon completion of the <br /> hearing (minutes attached) , the Commission voted 6 to 1 to deny <br /> the application. The Commission Chairman then informed the <br /> hearing participants that the Planning Commission' s action could <br /> be appealed to the Board of Supervisors provided the appeal was <br /> filed prior to 5 : 00 p.m. on September 26 , 1988 . Subsequently, no <br /> appeal was filed, and the appeal period expired. <br /> Under the circumstances just described, Planning Title Section <br /> 9-1113 (copy attached) requires a one-year wait before the appli- <br /> cant may reapply for a Use Permit for the same use on the same <br /> property. Section 9-1113 would, however, allow the Planning <br /> Commission to initiate the same application within the one-year <br /> period. <br /> Mr. Ronyak' s attorney, Steven Herum, has submitted a letter (copy <br /> attached) asking the Commission to waive the waiting period, ini- <br /> tiate the UP-88-16 reapplication, hold a new public hearing, and <br /> render its decision a second time . This sequence of events would <br /> create a new ten-day appeal period in which the applicant could <br /> file an appeal to the Board of Supervisors. <br /> The Planning Division has notified the participants of the pre- <br /> vious public hearing that the Planning Commission will review Mr . <br /> Herum' s request at its meeting of October 20 , 1988 .
