OBSERVATION: 1.According to Daniel Castro, Manager,the facility had its used oil picked up on 12/28/2019, as indicated on the used oil container's hazardous waste label (see photo IMG 0172). However, a consolidated manifest receipt from 12/28/2019 for the disposal of hazardous waste used oil was not found on site during the inspection. 2.A copy of consolidated manifest receipt from 9/13/2017 for the disposal of 155 gallons of hazardous waste used oil was not found on site during the inspection. REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Immediately locate a copy of consolidated manifest receipts from 12/28/2019 and 9/13/2017 and maintain them on site. Provide a copy of the consolidated manifest receipts from 12/28/2019 and 9/13/2017 for the disposal of hazardous waste used oil and a corrective action statement to the San Joaquin County Environmental Health Department. This is a Class II violation. 115 CCR 66266.81(a)(4)(B)Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. OBSERVATION: Bills of lading for the recycling of lead acid batteries from 2017 were not found on site.According to employee Rosemary Mejia,who is responsible for maintaining the bills of lading for the recycling of lead acid batteries, she did not have the spent lead acid batteries bills of lading from 2017. REGULATION GUIDANCE: (A)The generator shall use either the manifest or a bill of lading which fulfills the requirements of Title 13 CCR section 1161,to record the shipment of spent lead-acid storage batteries to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. (B)The generator shall retain, at the generator's place of business for at least three years, a legible copy of each manifest or bill of lading which identifies spent lead-acid storage batteries shipped to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. CORRECTIVE ACTION: Provide copies of 2017 battery core bill of lading records and a corrective action statement to the San Joaquin County Environmental Health Department within 30 days.
