The containers <br /> were: <br /> 1.A 55-gallon hazardous waste drum labeled as and containing drained and undrained used oil filters was missing <br /> the accumulation start date(see photos IMG 0171, 0173). <br /> 2.A 55-gallon hazardous waste drum labeled as and containing absorbent and oil was missing the accumulation <br /> start date(see photos IMG 0171, 0174). <br /> REGULATION GUIDANCE: All hazardous waste containers shall be marked with the following information: the <br /> words"Hazardous Waste", name and address of generator, hazardous properties, physical state, composition <br /> (contents), accumulation start date <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by Daniel Castro, Manager,who <br /> labeled the two drums mentioned above with the accumulation start date, 12/17/19. Disposal manifests reviewed at <br /> the time of inspection show that the most recent pick-up of drained/undrained oil filters and oily absorbent was on <br /> 12/21/19(see photos IMG 0243-5). No further action is required to correct this violation. <br /> This is a repeat violation, Class II. <br /> Overall Inspection Comments: <br /> NOTES: <br /> -Violation 103 was inadvertently marked on the inspection checklist and has been removed from the inspection <br /> report. <br /> -Violations 113 and 115 were added to the inspection report. <br /> -The facility had five 5-gallon color-coded hazardous waste containers, all of which were empty at the time of <br /> inspection (see photos IMG 0185, 0195-0204). According to a document titled "O'Reilly Waste Stream Legend" <br /> observed on top of the hazardous waste containers, these containers are designated for sorting the facility's <br /> damaged chemical products (see photo IMG 0205). According to Daniel Castro, Manager, the facility's damaged <br /> and customer returned chemical products (e.g. product with missing/broken caps, bent/broken packaging, and <br /> product that has been partially used) is either sold to other businesses, such as local auto repair shops (i.e. <br /> Magic Auto Repair; All Four One Auto Care; Mad Dog Towing) at a discounted price, or taken out of the facility's <br /> inventory to clean and maintain the facility. 2019 invoices and one 2018 invoice documenting the sale of <br /> damaged/customer returned products to other businesses were observed at the time of inspection (see photos <br /> IMG 0186-94). The EHD recommends that the facility keep the last three year's worth of invoices documenting <br /> the sale of damaged/customer returned products to other businesses. <br /> -The facility generated 10.67 tons of hazardous waste in 2019 and collected approximately 6 tons of hazardous <br /> waste (used oil and used oil filters)from the public is 2019, based on the facility's disposal manifests and public <br /> used oil logs reviewed at the time of inspection. <br /> FA0009438 PR0513836 SCO01 01/08/2020 <br /> EHD 22-01 Rev.9/20/2019 Page 8 of 9 Small Quantity Hazardous Waste Generator OIR <br /> 1868 E.
