1 <br /> Monte Vista Entitlement,Inc. <br /> Phase:I ESA Peer Review and Limited Phase II ESA Report <br /> November i8,2003 <br /> Page 5 <br /> • Removal of the hydraulic lifts in the former J C Penney store may have left behind soil contaminated <br /> with hydraulic oil. <br /> (* • A UST may be present on parcel 149-200-10 south of the.location of the previously removed tank. <br /> It is Condor's opinion that the potential UST located in the sidewalk immediately north of parcel 149- <br /> 200-10 poses minimal risk to the site. <br /> Condor recommends that an environmental professional be on site during demolition of the buildings and <br /> any excavation activities to observe and respond to environmental problems that may arise. <br /> Limitations <br /> y The findings and recommendations contained in this letter are based on a review of the Phase I ESA <br /> J� provided to Condor by the client; a review of Sanborn Fire Insurance Maps; a site reconnaissance of the <br /> outside areas of the parcels and the building basement; and a limited Phase lI ESA that included the <br /> advancement of two soil borings on July 31, 2002, the collection of soil samples from the borings, and the <br /> analysis of the soil samples by a California certified laboratory. The scope of work for this report is <br /> intended to provide a limited review of certain information related to the site and a limited investigation <br /> + into the potential existence of conditions of environmental concern associated with the possible presence <br /> of a UST on an adjoining property. This report does not include a .risk assessment. This report is not <br /> intended to eliminate all risk of the subject property bearing some degree of environmental liability. <br /> Condor cannot and will not warrant or certify that the site is free of contaminants, because it is impossible <br /> to know if such a condition exists. Although.risks can never be eliminated, more detailed and extensive <br /> investigations yield more information. This information may help .facilitate management of risks. <br /> This project was performed in general conformance with the technical scope of work prepared by Condor <br /> for Monte Vista Entitlement, Inc. The scope of work for this report was limited to a Phase I ESA peer <br /> review, a review of Sanborn Fire Insurance Maps, observation of the building basement, and. the <br /> advancement of two soil borings to investigate potential soil contamination on the site relating to a <br /> potential UST located on an adjacent property. Specifically excluded from the scope of work were(1) the <br /> evaluation of the site for the presence of asbestos, radon, and lead-based paint; (2) a survey of the site for <br /> wetlands or rare and endangered species; (3) a survey of the site for historical or cultural resources; and <br /> (4) research into the title history of the site. <br /> Condor has completed the Phase I ESA peer review and limited Phase II ESA as an independent <br /> contractor. The report was prepared with the customary.state of the practice and the prevailing standard of <br /> care for completing such reporting in California at this time. Condor shall not be subject to any expressed <br /> or implied warranties whatsoever. <br /> Land use site conditions (both on-site and off-site and other factors will chane over time. Site activities <br /> � ), g <br /> and regulations beyond our control could change at any time after the completion of this report. Our <br /> observations, findings, and opinions can be considered valid only as of the date of the site visit. The <br /> property owner is solely responsible for notifying all governmental agencies, and the public at large, of <br /> the existence, release, treatment, or disposal of any hazardous materials observed at the project site, either <br /> before or during performance of Condor's services. Condor assumes no responsibility or liability <br /> whatsoever for any claim, loss of property value, damage, or injury which results from pre-existing <br /> hazardous materials being encountered or present on the project site, or from the discovery of such <br /> hazardous materials. <br /> �a <br /> iSoF7 <br />
