We have reviewed your response dated February 8 , <br /> 1988 , but are not clear as to the appropriate permit requirements <br /> associated with the Terra Genesis project. <br /> San Joaquin County is presently reviewing an application for a <br /> use permit for the Terra Genesis project. Therefore , pursuant <br /> to Section 25199 . 3 (d) of the Health and Safety Code, we hereby <br /> make this request for technical assistance . Specifically, we would <br /> like your input on the following : <br /> 1 . Is the sample material submitted to your office by Terra Genesis <br /> on December 16 , 1987 classified as hazardous waste? If not , <br /> what is the proper classification for this material? <br /> 2 . Is there any correlation between the degree of contamination <br /> and the classification of saturated material as hazardous or <br /> nonhazardous waste? <br /> 3 . At what levels of concentration do soils saturated with petro- <br /> leum hydrocarbon substances become hazardous waste? <br /> 4 . Will a hazardous waste treatment facility permit be required <br /> by the Department of Health Services for the Terra Genesis <br /> project irrespective of the contaminant levels? <br /> 5 . Are there any measures available to Terra Genesis to qualify <br /> for an exemption or variance from the hazardous waste treat- <br /> ment facility permit requirement? <br />
