In a memorandum from Michael Infuma of the San Joaquin <br /> County Environmental Health Department(SJCEHD) dated March 2, 1998,he <br /> stated that back fees were owed from 1986 through 1989 and an office hearing <br /> was held on October 18, 1989. An agreement signed by Mr. Nagi Ali stated he <br /> would pay fees by December 18, 1989, have precision tests by November 18, <br /> 1989, and remove the tanks by January 18, 1990. Fees were not paid, precision <br /> tests were not performed, and the tanks were not removed by the dates <br /> established. <br /> Section 2811(a)(2)(13)(i) of the Petroleum Underground Storage Tank Cleanup Fund <br /> Regulations provides: <br /> "(B) For claims filed on or after January 1, 1994, the claimant had and has <br /> obtained any permit or permits required of the claimant pursuant to Chapter <br /> 6.7, Division 20, of the California Health and Safety Code, or had filed a <br /> substantially complete application for such permit or permits not later than <br /> January 1, 1990.
