According to SJCEHD and <br /> San Joaquin County property records, Mohamed and Huda Gubary purchased the property from <br /> Durhim Saleh-Ali in 1999. Mohamed and Huda Gubary's consultants conducted the investigation <br /> and remediation from 1999 through 2008, and they are currently claimants in the State Water <br /> Resources Control Board Underground Storage Tanks Cleanup Fund (the "Fund"). <br /> 13. According to SJCEHD and SJC Recorder records Munir Obiad and Talal Nasser purchased the <br /> property from Mohamed and Huda Gubary in 2004, and are the curren wners of the Site. <br /> 14. The Cenfr'al Va'll'eyWater Bbar0 s Water ity Control Plan for the Sacramento River and San <br /> Joaquin River Basins, 4th EditionIt-he "Basin Plan") designates beneficial uses of the waters of <br /> the State, establishes°water quality:objectives (WQOs) to protect these uses, and establishes <br /> implementation policies to implement WQOs. The Basin Plan designates the groundwater at the <br /> Site as supporting the municipal and domestic water supply beneficial use, the agricultural supply <br /> beneficial'use, the industrial service supply beneficial use, and the industrial process supply <br /> beneficial use. <br /> 16. The Basin Plan contains a narrative water quality objective for chemical constituents which <br /> requires, in part, that groundwater not contain chemical constituents in concentrations that <br /> adversely affect any beneficial use. For groundwater that is designated as supporting domestic <br /> and municipal supply, the Basin Plan incorporates by reference drinking water maximum <br /> contaminant levels ("MCLs") promulgated in Chapter 15 of Title 22 of the California Code of <br /> Regulations ("Title 22"). <br /> 17. The Basin Plan also establishes narrative water quality objectives for tastes and odors and <br /> toxicity. The taste and odor water quality objective requires, in part, that groundwater not contain <br /> substances in concentrations that cause nuisance, adversely affect beneficial uses, or impart <br />
