The toxicity water quality <br /> objective requires, in part, that groundwater be maintained free of toxic substances in <br /> concentrations that produce detrimental physiological responses in human, plant, animal, and <br /> aquatic life. <br /> 18. Waste constituents associated with releases at the Site threaten to impart objectionable tastes <br /> and odors to the groundwater, and threaten to produce detrimental physiological responses in <br /> humans if contaminated groundwater is used for municipal or domesti urposes. Therefore, the <br /> waste constituents released at the Site threaten to adversely affect ignated beneficial <br /> uses. <br /> 19. Water Code section 13267 states, in part: <br /> (b)(1) In conducting an investigation . . ., the regio oa may req t any person who has <br /> discharged, discharges, or is suspected of havin ed or, disch t9or who proposes to <br /> discharge waste within its region . . . shall fur , under penalty of perjury, technical or <br /> monitoring program reports which the regio oard req es. The burden inoltitiig costs, of <br /> these reports shall bear a reasonable rel to then for the report and 'Vbenefits to be <br /> obtained from the reports. In requiring those re the I.board shall pr ide the person <br /> with a written explanation with regard to the nee ports, and shall iden ify the evidence <br /> that supports requiring that person to provide the re <br /> Furthermore, the California Code of R ns, title 23, se 20, defines a "responsible <br /> party" as: <br /> .. any person who owns or operate and ra nk used for the storage of an <br /> hazardous substance... any person o d or he underground storage tank <br /> immediately b " iscontinuation use... any ner of property where an unauthorized <br /> release of 01!r% stance from undergroun storage tank has occurred, and any <br /> person ad or hastrol over a un round storage tank at the time of or following an <br /> unaut lease of azardous subs <br /> A responsible party he igate and remediate contamination. The reports <br /> requiredjt y this Order ar eded to ensure protection of waters of the state and to protect public <br /> health. <br /> 20 Water Code s 13 states, in part: <br /> (a)(1) Any son failing or refusing to furnish technical or monitoring program reports as required <br /> by subdi ion (b) of Section 13267 . . . or falsifying any information provided therein, is guilty of a <br /> misdemeanor and may be liable civilly in accordance with subdivision (b). <br /> (b)(1) Civil liability may be administratively imposed by a regional board in accordance with Article <br /> 2.5 (commencing with Section 13323) of Chapter 5 for a violation of subdivision (a) in an amount <br /> which shall not exceed one thousand dollars ($1,000) for each day in which the violation occurs. <br />
