RWQCB Case#:390609 <br /> Riverbank, CA. 95367 CUF#: 015211 <br /> The San Joaquin County Environmental Health Department's (EHD) Local Oversight <br /> Program staff has provided regulatory oversight of corrective actions taken to address <br /> subsurface contamination at the above referenced former underground storage tank <br /> (UST) site since 26 November 1996. The contamination resulted from an unauthorized <br /> release or releases from the former UST system. <br /> This site is currently out of compliance with regulatory directives to conduct and report <br /> routine groundwater monitoring, to submit reports of findings for the investigation done in <br /> 2007, and to provide accurate and valid responsible party contact information. The EHD <br /> considers it imperative that investigative data collected previously be submitted to the <br /> EHD for evaluation and to determine what corrective action, if any, may be needed at this <br /> site. The EHD has been advised by the last consultant for the responsible party that since <br /> they have not been paid for the last investigative phase, the report will not be released to <br /> the EHD. The EHD has been in contact with the Fraud Division of the State Water <br /> Resources Control Board (SWRCB) Clean Up Fund (CUF) and has verified that the <br /> responsible party is being investigated for failure to provide receipts of payment to the <br /> consultant. <br /> The last groundwater monitoring data (September 19, 2008) has shown that gasoline <br /> range organics in the most impacted well (MW-3) were present at 86,000 micrograms per <br /> liter (Ng/L). A private drinking water well has already been destroyed and replaced due to <br /> petroleum contamination impact that emanated from this site and the EHD believes this <br /> plume should be promptly and properly managed to minimize the potential of impacting <br /> additional private wells located in the immediate area. <br /> Due to the responsible party's non-compliance with EHD directives and the urgency for <br /> proper investigation and management of the impact to groundwater at this site, the EHD is <br /> referring this site to you for oversight as the lead regulatory agency and for enforcement <br /> action if appropriate. A site chronology is enclosed. <br />
