CONDITIONS OF APPROVAL <br /> SA-93-33 <br /> Dan Phelps <br /> Unless otherwise specified, all Conditions of Approval must be fulfilled prior to the establishment of <br /> the use and the issuance of any building permits. <br /> This approval will expire within 18 months of the date of approval unless (1) all Conditions of <br /> Approval have been complied with, (2) all necessary building permits have been secured and remain <br /> in force, and (3) all necessary permits from other agencies have been secured and remain in force. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance Requirements. Ordinance Requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. This approval shall be for an existing contract grain harvesting operation, involving the <br /> storage and maintenance of associated equipment and supplies. The area to be used <br /> for outside storage of the related equipment shall be shown on the Improvement Plan. <br /> There shall be no outdoor storage of supplies associated with the approved use. This <br /> approval includes the use of the existing 2,640-square-foot shop/portable storage/covered <br /> work area building. This approval shall not permit a truck terminal or a junkyard. <br /> b. Submit an Improvement Plan, within thirty (30) days of the effective date of the approval, <br /> showing drainage, driveway access details, on-site parking, existing and proposed utility <br /> services, and grading. Storm drainage run-off shall be retained on the site. Drainage <br /> patterns and details shall be shown on the Improvement Plan. The Improvement Plan <br /> shall accurately reflect all the parcel's property lines. A plan check fee will be required. <br /> (Development Title Section 9-884) Except as otherwise noted in the Conditions of <br /> Approval, all required improvements shall be installed within ninety (90) days of the <br /> effective date of the approval. <br /> C. All driveways and maneuvering areas shall be surfaced with a permanently-maintained <br /> durable, dust-free surface: consisting at a minimum of six (6) inches of road base. <br /> Surfacing details shall be included on the Improvement Plan. Bumper guards shall be <br /> provided where necessary to protect adjacent structure or properties. <br /> d. The applicant shall secure an approved Business License prior to the initiation of the use. <br /> (Section 7-1000 of the County Ordinance Code) The Business License application shall <br /> be submitted within thirty (30) days of the effective date of the approval. <br /> e. Approved permits for use of the above-ground fuel tank and dispensing system shall be <br /> required from the San Joaquin County Fire Prevention Bureau and the Tracy Rural Fire <br /> District prior to approval of the Improvement Plan and issuance of the Business License. <br /> f. Any proposed night or security lighting for the approved use shall be designed to confine <br /> direct rays to the premises. No spillover beyond the property lines shall be permitted, <br /> except onto public thoroughfares, provided, however, that such light shall not cause a <br /> hazard to motorists.
