State of California—California Environmen,, ,otection Agency Department of Toxic Substances Control
Exemption Status: (check one)
❑Ministerial [PRC, Sec. 21080(b)(1); CCR, Sec. 15268]
❑ Declared Emergency[PRC, Sec.21080(b)(3);CCR, Sec.15269(a)]
❑ Emergency Project [PRC, Sec. 21080(b)(4);CCR, Sec.15269(b)(c)]
® Categorical Exemption:[State type and section number] California Code of Regulations,Title 14, section 15330.
❑ Statutory Exemptions: [State code section number]
❑ General Rule [CCR, Sec. 15061(b)(3)]
Exemption Title: Title 14, California Code of Regulation (CCR), Section 15330 Minor Actions to Prevent, Minimize,
Stabilize, Mitigate or Eliminate the Release or Threat of Release of Hazardous Waste or Hazardous Substances.
Reasons Why Project is Exempt:
1. The cleanup will be performed for less than the one million dollar regulatory limit.
2. The site is not on the Hazardous Waste and Substances site list pursuant to Government Code Section
65962.5.
3. A Site Health and Safety Plan, prepared in accordance with state and federal requirements Title 8 CCR 5192
and 29 Code of Federal Regulation (CFR) 1910.120,will protect the worker and the public during the remedial
action.
4. Given the Site's small size and its location in the middle of a mixed commercial, industrial, residential use area,
it was concluded that a full ecological risk assessment was not necessary. No parks, wildlife refuges or other
protected areas are located within one mile of the site. There are no water courses on the project site that
would provide habitat for species. There will be no substantial adverse effect on any riparian habitat or other
sensitive natural community. The California Natural Diversity Database was searched and no species; etc were
found to exist on the site. The project will not interfere with the movement of any native resident or migratory
fish or wildlife species or with established native resident or migratory wildlife corridors or impede the use of
native wildlife nursery sites.
5. Remediation of the site will protect the public and allow the site to continue to be used for commercial or
industrial purposes.
6. The Native American Heritage Commission and the City Planning Office of Stockton were consulted and no
records of cultural resources were found to be associated with the site.
Dean Wright Engineering Geologist (916)255-6528
Project Manager Name Project Manager Title Phone#
/DY
J ranch Chief Signature Date
Jim Tjosvol Supervising Hazardous Substances Eng.
