Non-contact water will be pumped to the existing retention <br /> pond. Contact water will be treated and used in the production process or treated to below MCLS <br /> before being released to the onsite retention pond. The metal reduction treatment system that is <br /> currently located in Stockton will be moved to the Lathrop site for use with their existing water <br /> treatment systems. This is the same treatment system that the Board approved for use in pre- <br /> treating contact storm water for discharge at the Stockton plant. The same protocol previously <br /> approved will be utilized. <br /> MLT has continued to work to re-use the material in the production process; however, due to the extreme drop in <br /> housing market last year, re-use was significantly reduced as previously noted. MLT believed that the housing <br /> market would recover quickly; however, the downturn in the market now appears to be a permanent shift with <br /> recovery expected in years rather than months. While MLT has continued to re-use the material, we have <br /> recognized that the original projections cannot be reasonably met under current and expected conditions. <br /> Therefore as noted above, re-use calculations have been developed and excess material disposal has been initiated. <br /> With the current projections and planned disposal,we will meet the new requested dates. <br /> To demonstrate our commitment to have all material removed in September 2008;MLT is willing to pre-agree to a <br /> stipulated penalty if the date is not met,if desired by the Board to grant the extension. We believe this will provide <br /> the WQCB a guarantee of our commitment to meet the Consent Order. MLT is confident in making the offer, as <br /> we are committed to meeting the Consent Order requirements. <br /> MLT also recognizes that with the extension, ground water monitoring at the Lathrop facility will continue at the <br /> current semi-annual rate until the pile is removed and closure of the site is obtained. <br /> We look forward to your determination on this request.
