SAN J O A Q U I N Environmental Health Department <br /> -COU N T Y--- AMENDED <br /> 5/12/2020 <br /> Large Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> DELTA TRUCK CENTER 10812 S HARLAN RD, FRENCH CAMP May 11,2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 204 HSC 25201(a) Failed to obtain a permit to treat hazardous waste. <br /> OBSERVATION: This facility is treating hazardous waste. A permit to operate the HW treatment system has not <br /> been issued by the San Joaquin County Environmental Health Department(EHD)or other regulatory agency. <br /> The facility has a steam cleaner bay to wash oily transmission and engine parts. The oily water and solids flow into <br /> drains and through a three compartment underground separator. When the liquid in the last compartment of the <br /> separator reaches a certain height,the liquid is automatically pumped out into an above ground oil skimmer <br /> container. The oil is skimmed off and placed in the onsite used oil tank for storage until disposal as hazardous <br /> waste. The aqueous portion is pumped into an intermediate holding tank. The liquid is pumped from the holding <br /> tank into a container with a heating unit. The container is heated to evaporate the aqueous fraction leaving a solid <br /> sludge. The solid sludge layer builds up over time and is hauled from the site as non-RCRA hazardous waste. <br /> The underground separator, oil-skimmer container, and holding tank are also periodically cleaned out with the waste <br /> being hauled from the site as hazardous waste. <br /> REGULATION GUIDANCE: <br /> California Health&Safety Code(HSC)section 25201(a) <br /> No owner or operator of a storage facility or treatment facility shall treat,store, or dispose of a hazardous waste at <br /> the facility, unless the owner or operator holds a hazardous waste facilities permit or other grant of authorization <br /> from the department to use and operate the facility, or the owner or operator is operating under a permit-by-rule <br /> pursuant to the department's regulations, or a grant of conditional authorization or conditional exemption pursuant to <br /> this chapter. <br /> Title 22 California Code of Regulations section 66260.10 <br /> "Treatment"means any method,technique, or process which changes or is designed to change the physical, <br /> chemical, or biological character or composition of any hazardous waste or any material contained therein,or <br /> removes or reduces its harmful properties or characteristics for any purpose including, but not limited to, energy <br /> recovery, material recovery or reduction in volume. <br /> Also see HSC 25123.5, 25179.2(e) <br /> CORRECTIVE ACTION: Immediately cease treatment of hazardous waste until a permit is issued by the EHD, <br /> California Department of Toxics Substances Control or the United States Environmental Protection Agency. Store <br /> and dispose of the hazardous waste as specified in Title 22 California Code of Regulations until the treatment permit <br /> is obtained. Contact the appropriate regulatory agency to initiate the permit process.
