r 3 <br /> RESPONSIBLE PARTY IDENTIFICATION <br /> FISCAL YEAR 1.992-93 CONTRACT <br /> At BOTH federal and state funded sites, the following definition <br /> ,, will be used for responsible party. This definition is <br /> ` paraphrased here. It is contained in full in .Section Two, <br /> Letter P (Page 3 of 19) in your contract. <br /> The owner and/or operator of an UST from which an <br /> unauthorized release has taken place, and ever other <br /> person, organization, or agency which is legally <br /> responsible for repayment of moneys. The term includes <br /> all persons, organizations, and agencies classified as <br /> Responsible Parties by applicable State Board <br /> regulations. <br /> This includes: <br /> 1) any person who owns or operates' an UST used to store <br /> petroleum <br /> 2) for USTs no longer in use, the current owner of the UST <br /> 3) Anyone who owned or operated the UST immediately before <br /> discontinuation of its use <br /> 4) Any owner of property where an unauthorized release of <br /> petroleum from an UST has occurred <br /> 5) Any person who had or has control over an -UST at the time <br /> of or following an unauthorize& release of petroleum <br /> occurred. <br /> .. In all cases funded by the federal Petroleum Trust Fund, be sure <br /> to identify the RCRA responsible party. This means: <br /> For USTs brought into use before and after November 8 , 1984, <br /> any person who owns the UST. <br /> For USTs no longer in use on November 8, 1984, anyone who <br /> owned the UST immediately before the discontinuation of its <br /> use. <br /> , Once these persons have been identified, you can then broaden <br /> Your identification of responsible party to include Numbers 1-5 <br /> above. <br /> If you are unable to identify anyone meeting the RCRA definition, <br /> the UST will be considered abandoned for EPA purposes and you may <br /> , name someone in Numbers 1-5. <br />
