err y <br /> - SPECIFICATIONS (continued) WRCB No. B-116-550-0 <br /> San Joaquin Local Health District <br /> retesting performed as part of an UST monitoring program is <br /> not covered under this contract. <br /> 2. - As soon as possible following start of work on a suspected <br /> release, the Contractor shall determine which source of <br /> contract funds (state or federal) will be used to oversee work <br /> at the site. Funding decisions shall be based on the <br /> eligibility of the site (e.g. , federal funds may be used only <br /> for petroleum sites and state funds may be used for all <br /> hazardous substances, including petroleum) and the remaining <br /> contract funds available to the Contractor. All contract <br /> charges for a site must be from the same fund source. <br /> B. TASK 2: IDENTIFY AND NOTIFY OWNER <br /> 1. The Contractor shall identify the Responsible Party or conduct <br /> an investigation, if necessary, to make such identification. <br /> This investigation shall , at minimum, include a review of land <br /> title records at the County Recorder's office to identify the <br /> last assessee of record. All cases for which a Responsible <br /> Party can not be identified shall be reported to the State <br /> Board as specified in Section Three of this exhibit. <br /> 2. Prior to initiating work at a site, the Contractor shall , <br /> `- " using language specified by the State Board, notify each <br /> Responsible Party of his obligation to investigate and remedy <br /> UST releases and to reimburse the State Board, the Department, <br /> EPA or their authorized representative for all direct and <br /> indirect costs incurred by the Contractor in conducting work <br /> under this contract and any reasonable administrative or other <br /> costs incurred by the State Board or the Department, including <br /> interest on bonds sold to establish the state fund. A copy of <br /> this notice shall be furnished to the State Board within ten <br /> days following notification of the Responsible Party. <br /> C. TASK 3: PRELIMINARY SITE ASSESSMENT <br /> 1. The Contractor shall oversee performance of a preliminary <br /> -assessment of confirmed UST release sites. The purpose of the <br /> preliminary assessment is to determine the extent of existing <br /> soil contamination and whether ground water has been affected. <br /> Soil samples shall be obtained to determine the concentration <br /> of pollutants in the soil and the vertical and lateral extent <br /> of contaminated soil . The Contractor may use contract funds <br /> to take and analyze soil or ground water samples.
