Sacramento Road <br /> Woodbridge, CA 95258 <br /> UNDERGROUND STORAGE TANK CLEANUP FUND (FUND) : PETITION OF JOSEPH <br /> NEWFIELD, CLAIM NO. 3154, OCC FILE NO. UST-37 . <br /> The above-entitled petition has been forwarded to me for further <br /> action. <br /> My review of your petition indicates that you purchased the <br /> subject property in September of 1979 . In September of 1987 , <br /> four underground storage tanks were removed from the site and <br /> during tank removal activities, contamination was suspected. In <br /> October of 1987, you submitted a soil analysis to the San Joaquin <br /> County Department of Public Health Services (County) which <br /> confirmed soil contamination. You proceeded with site assessment <br /> in November of 1989 , but that work came to an abrupt halt. You <br /> have not conducted any further site assessment or taken any <br /> further corrective action since November of 1989 . After <br /> conducting a detailed review of your claim, Cleanup Fund staff <br /> determined, and the County concurred, that you are not in <br /> compliance with corrective action requirements and are therefore <br /> not eligible to access the Fund. <br /> As you know from prior communications with State Water Resources <br /> Control Board (State Water Board) staff, various sections of the <br /> California Health and Safety Code condition access to the Cleanup <br /> Fund on a claimant' s compliance with corrective action orders or <br /> directives issued by a local agency or a Regional Water Quality <br /> Control Board (Regional Water Board) . The relevant sections of <br /> the Health and Safety Code include the following sections: <br /> "Except as provided in subdivisions (b) , (c) , (d) , <br /> and (e) an owner or operator, required to perform <br /> corrective action pursuant to Section 25299 . 37, or <br /> an owner or operator who, as of January 1, 1988, is <br /> required to perform corrective action, who- has <br /> initiated this action in accordance with Division 7 <br /> (commencing with Section 13000 ) of the Water Code, <br />
