ENVIRONMEN`T'AL HEALTH <br /> Woodbridge, CA 95258 �R1�e'I� �dTQ � <br /> Dear Mr. Newfield: <br /> UNDERGROUND STORAGE TANK CLEANUP FUND PROGRAM <br /> FINAL DIVISION DECISION (INTENT TO REMOVE FROM PRIORITY LIST) <br /> CLAIM NO. 3154 (Joseph Newfield) <br /> Pursuant to your request, I have reviewed the staff decision to <br /> remove your claim from the Priority List. In your letter dated <br /> October 8, 1992 requesting that I reconsider removing you from <br /> the Priority List you state that you have done everything within <br /> your_ power to comply with directives issued by San Joaquin Public <br /> Health Services (county) . <br /> You removed five tanks from 107 N. School Street, Lodi on <br /> September 27, 1987 and there was noticeable odor observed. Soil <br /> contamination was confirmed October 8, 1987 by lab results. On <br /> October 20, 1987 you were directed by the county to submit soil <br /> samples and a proposal for a groundwater investigation. <br /> Since that time, county records indicate that you have failed to <br /> meet deadlines or cooperate with the local regulatory agency in <br /> the investigation and remediation of the site. This resulted in <br /> your case being referred to the Regional Board for enforcement <br /> action. The Regional Board by letter of September 30, 1991 <br /> directed you to submit a Preliminary Investigation and Evaluation <br /> Report by October 30, 1991. <br /> The records indicate that you have ignored both local and <br /> regional board directives and have been consistently <br /> uncooperative in providing the required contamination reports. <br /> Section 25299. 54 (a) of the California Health and- Safety Code <br /> (H&SC) states that: <br /> Except as provided in subdivisions (b) , (c) , and (e) an <br /> owner or operator, required to perform corrective action <br /> pursuant to Section 25299 . 37, or an owner or operator who, <br /> as of January 1, 1988, is required to perform corrective <br /> action, who has initiated this action in accordance with <br /> Division 7 (commencing with Section 13000) of the Water <br /> Code, who is undertaking corrective action in compliance <br /> with waste discharge requirements or other orders issued <br /> pursuant to Division 7 (commencing with Section 25280) , may <br /> apply to the board for satisfaction of a claim filed <br /> pursuant to this article. <br />
