Final Division Decision �� 8 � 1 <br /> Claim No. 3154 <br /> Joseph Newfield <br /> Page 2 <br /> Section 25299.54 (d) of the H&SC provides that: <br /> An owner or operator who violates Article 4, (commencing <br /> with Section 25299. 36) is liable for any corrective action <br /> costs which result from the owner's or operator's violation <br /> of Article 4 (commencing with Section 25299 . 36) and is <br /> ineligible to file a claim pursuant to this section. <br /> Section 25299 . 37 (c) of the H&SC provides that: <br /> The local agency may issue an order to the owner, operator, <br /> or other responsible party requiring compliance with this <br /> section, including a time schedule or completion of specific <br /> action. . . .The owner, operator, or other responsible party <br /> shall conduct corrective action in accordance with any order <br /> issued by a local agency or cleanup and abatement order <br /> issued pursuant to this section. <br /> Section 2811 (a) (4) of the Underground Storage Tank Cleanup Fund <br /> Regulations provides that an owner or operator shall be eligible <br /> only if: "The claimant took corrective action in accordance with <br /> any applicable provision of Chapter 6.7 (commencing with Section <br /> 25280) of the California Health and Safety Code and the Federal <br /> Act;" <br /> Consequently, it is my decision and the Final Division Decision <br /> that your failure to comply with the corrective action <br /> requirements has resulted in your disqualification from <br /> participating in the Underground Storage Tank Cleanup Fund <br /> Program. <br /> If you are not in agreement with this Final Division Decision, <br /> you may file a petition for review by the State Water Resources <br /> Control Board within thirty (30) calendar days from the date of <br /> receipt of this letter as provided for in Article 5 of the <br /> Petroleum Underground Storage Tank Cleanup Fund Regulations, <br /> Title 23 , Division 3, Chapter 18, of the California Code of <br /> Regulations dated December 2, 1991. <br /> Please send any petition for review to Mr. W. Don Maughan, <br /> Chairman, with copies to Mr. William R. Attwater, Chief Counsel, <br /> and Mr. Harry M. Schueller, Chief Division of Clean Water. The <br /> petition must be addressed to: <br /> State Water Resources Control Board <br /> P. O. Box 100 <br /> Sacramento, CA 95812-0100 <br />
