C <br /> Emergency,Abandoned, Recalcitrant Account Nomination <br /> Joseph Newfield III- Newfield Property <br /> 107 North School Street <br /> Lodi CA 95240 <br /> Site Code: 1371 <br /> Identified Potentially Responsible Party <br /> Joseph Newfield III <br /> 19000 Lower Sacramento Road <br /> Woodbridge CA 95258 <br /> Local Oversight Agency Requesting the Direct Site Funding <br /> Margaret Lagorio,Supervisor (209)468-3449 <br /> San Joaquin County Public Health Services, Environmental Health Division <br /> 304 East Weber Ave,Third Floor <br /> Stockton CA 95202 <br /> Final Corrective Action Order <br /> See the attached PHS/EHD correspondence dated January 3, 1997. <br /> Unauthorized Release Description <br /> PHS/EHD initially learned of the presence of the former underground storage tanks(USTs)through a complaint <br /> received on February 24. 1987. On September 21, 1987,the five USTs were finally removed and soil samples <br /> were collected that evidenced petroleum hydrocarbon contamination,as TPH-gas, benzene,toluene,and <br /> xylene and as PCB 1242. On October 13, 1987 a limited excavation was performed to a maximum depth of <br /> 26 feet below ground surface(bgs). PHS/EHD was informed that the analytical results from the soil sample <br /> that was collected from the excavation was"not good". Unfortunately, PHS/EHD never received the analytical <br /> results from this sample despite numerous requests. An additional excavation attempt to 30 feet bgs was <br /> proposed on October 28, 1987,and approved by PHS/EHD; however, no further remedial work at the site has <br /> occurred. A work plan dated August 23, 1989 was submitted to investigate the remaining contamination <br /> and to verify that clean soil was placed in the excavation which was necessary because.despite having been <br /> informed of the requirements of the City of Lodi for a grading permit to backfill the excavation, no permit was <br /> obtained and the excavation backfilled without proper documentation. On November 28, 1989, a single <br /> borehole was drilled and contamination was observed to 40 feet bgs. PHS/EHD was informed that due to <br /> payment problems,the soil samples would not be submitted for analysis nor would a report be prepared. No <br /> additional investigation has been implemented. <br /> It is highly probable that groundwater has been impacted because seasonal high depth to water in the area of <br /> the site is approximately 40 feet bgs(1986 SJC Flood Control). The nearest municipal well,located <br /> approximately 250 feet northwest of the site, is identified as the City of Lodi municipal well#2 which <br /> produced over 186 million of gallons of water in 1996. This well's total depth is 310 feet and is constructed <br /> as an open bottom well with blank casing placed at the following intervals: 0-109', 121 - 146', 180- 226', <br /> and 228 -263 according to the video log obtained from the well in 1990. <br /> Responsible Party's Compliance Description <br /> The responsible party has clearly demonstrated recalcitrance. The responsible party has failed to comply with <br /> directives issued by PHS/EHD and the Central Valley Regional Water Quality Control Board. The State Water <br /> Resources Control Board has deemed the site ineligible for cleanup funds due to the responsible party's failure <br /> to comply with PHS/EHD's directives. Additionally, PHS/EHD has requested that the responsible party <br /> demonstrate insolvency if funds are not available to perform the necessary investigation and/or remediation. <br /> The responsible party has failed to submit supporting documentation in response to PHS/EHD's numerous <br /> requests. <br /> Dispute Documentation <br /> There have been no formal disputes between the responsible party and this regulatory agency. <br /> Description of the Proposed Cleanup and/or Abatement <br /> The initial scope of work would include a soil and groundwater investigation to assess the remaining soil <br /> contamination and to determine the extent of the suspected groundwater contamination plume. Once the <br /> extent of the soil and groundwater contamination has been delineated and risk determined,soil and/or <br /> groundwater remedial alternatives will be considered for implementation. <br /> Funding Reauested <br /> S 100,000 per year will be requested initially to ensure that there will be adequate funds to perform the <br /> necessary environmental investigation to define the extent of the contamination and thereby have information <br /> regarding the risk that the site poses to public health and the environment. It is estimated, based on average <br /> site costs,that the total costs to achieve site certification will not exceed $300,000. <br />
