<br /> San Joaquin County Public Health Services, Environmental Health Division (PHS/EHD) has reviewed
<br /> the status of the above referenced site and has prepared the following comments for your
<br /> consideration
<br /> Compliance History
<br /> On February 24, 1987, PHS/EHD received a complaint that there were abandoned underground
<br /> storage tanks at the site. During the February 27, 1987 site visit, you informed PHS/EHD that a
<br /> tank(s) closure plan would be submitted in a few days. You then requested in correspondence
<br /> dated May 27, 1987, an extension of time for the removal of the tanks. PHS/EHD informed you in
<br /> correspondence dated June 11, 1987 that there were no provisions in the law for allowing tanks to
<br /> remain inactive without being tested, monitored, and permitted. However, PHS/EHD on June 30,
<br /> 1987, granted an extension until September 1, 1987 for the submittal of a closure plan to remove
<br /> the tanks. On September 21, 1987, five underground storage tanks were removed and the sail in
<br /> the tank excavation was observed to have petroleum odor.
<br /> On October 13, 1987, a limited excavation was performed to 26 feet below ground surface (bgs).
<br /> On October 20, 1987, you informed PHS/EHD that the soil sample results were "not good" and
<br /> PHS/EHD requested submittal of the soil results and a proposal for a groundwater investigation.
<br /> You proposed on October 28, 1987 to re-excavate to 30 feet bgs and you stated that you would
<br /> not install monitoring wells. PHS/EHD approved of the proposed excavation, which never occurred,
<br /> and informed you that a groundwater investigation would still be required. The City of Lodi in
<br /> correspondence dated December 3, 1987, informed you of the requirements to obtain a grading
<br /> permit for backfilling the excavation. Sometime prior to March 21, 1989, "clean soil" was delivered
<br /> to the site and the tank pit backfilled without a City of Lodi grading permit for the compacting of
<br /> the backfilled material.
<br /> On September 13, 1989, Warren Gomes Excavating submitted a soil investigation proposal. The
<br /> site was placed into the Local Oversight Program on October 13, 1989. On November 28, 1989,
<br /> strong hydrocarbon odors were noted during the drilling of one 40 foot borehole. The drilling was
<br /> halted and the boring grouting.
<br /> On June 11, 1990, PHS/EHD issued correspondence requesting that a proposal for a groundwater
<br /> investigation be submitted within 14 days. In a telephone conversation, Richard Novone, the
<br /> property owner of the site at that time, provided FHS/EHD with information that he planned to allow
<br /> the land to fall into default and become the property of San Joaquin County. On August 22, 1990,
<br /> you, Richard Navone and the City of Lodi were informed in correspondence by PHS/EHD that a
<br /> meeting was scheduled for September 26, 1990 to discuss the failure to submit information and the
<br /> groundwater investigation proposal requested by PHS/EHD. Richard Novone stated in
<br /> correspondence dated September 11, 1990 that he was unable to afford any further costs
<br /> associated with the contamination and that he could not attend the meeting scheduled because he
<br /> was currently working in a work furlough program with the San Joaquin County Jail.
