Box 388 <br /> 304 East Webber <br /> Stockton, CA 95202- <br /> Re: The Atchison, Topeka & Santa.Fe Railway Company v. <br /> California Packing (Del Monte Corporation), -et al. <br /> Site: 1033 East Scott Avenue and 1022 West Hazelton <br /> Stockton, CA <br /> Dear Mr. Knoll: <br /> This will confirm our recent telephone conferences in which you advised that <br /> two of the,three groundwater monitoring wells-have been properly closed and-abandoned. <br /> The third well, on Lanny Williams' property, has been closed, but not yet completely <br /> I <br /> abandoned because Mr. Williams became unhappy with the work of Santa Fe's contractor, <br /> ERM-West, and revoked access. <br /> i <br /> You indicated that the well on Mr. Williams' property still needs to be topped <br /> - off and the pipe-at-the top removed. <br /> You further advised that the Environmental Health Division will proceed to <br /> issue a closure letter insofar as Del Monte and Santa Fe are concerned, `and to issue another <br /> letter to Mr. Williams instructing him to complete the work on the third well. <br /> You indicated that you hoped_to issue-the closure letter by the end of this week. <br /> We would be most appreciative if you will,be able to do so, as that will be an important step <br /> toward resolution of the pending litigation regarding the site. Legal fees and costs continue <br /> to mount as long as the matter remains pending, and site closure will allow the parties to <br /> assess their positions and proceed with settlement discussions.. <br /> I <br />
