S0 JOA U 1 Environmental Health Department <br /> U ; i y <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> ESTES TRUCKING 7611 S AIRPORT WAY, STOCKTON January 29, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 103 CCR 66262.40(c) Failed to retain hazardous waste determination including waste analysis on site for 3 years. <br /> OBSERVATION: 70 pounds of printer toner waste was disposed of as non-hazardous waste, according to <br /> non-hazardous waste manifest 18-16517-001 dated 11/29/2018.The manifest noted a profile#: 070128043-14390 <br /> and PO#: 742522.The business operator does not have hazardous waste determination records that support the <br /> handling and disposal of the printer toner waste. <br /> REGULATION GUIDANCE:A business operator shall keep records of any hazardous waste determinations made <br /> in accordance with Title 22 California Code of Regulations(CCR)section 66262.11 for at least three years from the <br /> date that the waste was last sent to an on-site or off-site treatment, storage, or disposal facility. The records may <br /> include Safety Data Sheets(SDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Assemble the hazardous waste determination documentation for the printer toner waste, <br /> maintain on site and submit a copy to the San Joaquin County Environmental Health Department(EHD). <br /> If hazardous waste determination documentation is not available, immediately make a hazardous waste <br /> determination and begin managing the printer toner waste as specified in Title 22 CCR. Use Safety Data Sheets <br /> (SDS),waste sampling and test results or other knowledge to support your hazardous waste determination. Waste <br /> testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a <br /> statement and supporting documentation with your hazardous waste determination. <br /> Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal <br /> records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title <br /> 22 CCR for your hazardous waste generator status. <br /> This is a Class II violation. <br /> 105 CCR 66262.34(d)(2)No emergency coordinator. <br /> OBSERVATION: The modified contingency plan posted in Bill Wardell's,Terminal Manager, office listed James <br /> Mozingo as the primary emergency coordinator.According to Bill, James no longer works at the facility. <br /> REGULATION GUIDANCE: The emergency coordinator or his designee must respond to any emergencies that <br /> arise. The business operator must post the following information next to telephones or in areas directly involved in <br /> the generation and accumulation of hazardous waste: the name and emergency telephone number of the <br /> emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of <br /> the fire department unless the facility has a direct alarm. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by Bill Wardell,who removed James <br /> Mozingo as the emergency coordinator and assigned himself as the primary emergency coordinator on the <br /> modified contingency plan.
