WASTE DISCHARGE REQUIREMENTS -6- <br />J.R. SIMPLOT COMPANY <br />LATHROP, SAN JOAQUIN COUNTY <br />4. Simplot shall report promptly to the Board any material change or proposed <br />material change in the character, location, or volume of the discharge. <br />For the purposes of these requirements, this includes any proposed mater- <br />ial change in the boundaries, contours, or use of chemical handling <br />facilities. <br />5 Prior to any change in control or ownership of land or waste discharge <br />facilities presently owned or controlled by Simplot, Simplot shall notify <br />the succeeding owner or operator of the existence of this Order by letter, <br />a copy of which shall be forwarded to this office. <br />6. The Board will review this Order periodically and may revise requirements <br />when necessary. <br />7. This Board considers Simplot to have a continuing responsibility for <br />correcting any problems which may arise in the future as a result of <br />Simplot's waste discharge or of water applied to this property during <br />subsequent use of the land for other purposes; except Simplot shall not be <br />responsible for ground water or soil contamination attributable to opera- <br />tions on this site by the previous owner prior to 1 January 1983. To the <br />extent of any conflict between this provision and the Stipulation, the <br />Stipulation shall govern. <br />8. Forty-five (45) days prior to discontinuing the use of this site, Simplot <br />shall submit a technical report to the Board describing the methods and <br />controls to be used to assure protection of water quality of the area <br />during final operation and any proposed subsequent use of the land. This <br />report shall be prepared by or under the supervision of a registered <br />engineer, certified engineering geologist, or persons or firms qualified <br />in this field. <br />9. A copy of these requirements, along with Section 13350(a) and 13387 of the <br />California Water Code, shall be posted in a conspicuous area where they <br />may be read by employees handling or managing toxic or hazardous materials. <br />10. The waste discharge requirements under Order No. 82-099 are rescinded. <br />I, WILLIAM H.
