i The following is an itemized list of hazardous waste violations that have not been addressed for FWS CONSTRUCTION as of March 27, 2020. Open violations from January 14, 2020 inspection Violation#101 -Managed a hazardous waste without an identification number. OBSERVATION This business does not have an active hazardous waste ID number in the California Department of Toxic Substances Control(DTSC) database. REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of, transport or offer for transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification (ID) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month, less than 1 kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID numbers are unique to a business and site location. CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ to reactivate your State ID number . Immediately reactivate your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days. ❑ This violation was corrected ❑ This violation will be corrected by (date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation #110- Failed to keep signed copy of manifests from the designated facility for three years. OBSERVATION The business operator could not provide hazardous waste disposal records for the past three years during the inspection. REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a) for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. CORRECTIVE ACTION: Provide a copy of disposal records for the past three years January 14, 2017-January 14, 2020 for all hazardous waste including used oil, used oil filters, and metal fines.
