The following is an itemized list of hazardous waste violations that have not been <br /> addressed for FWS CONSTRUCTION as of March 27, 2020. <br /> Open violations from January 14, 2020 inspection <br /> Violation#113- Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years January 14, 2017-January 14, <br /> 2020 for all hazardous waste including used oil, used oil filters, and metal fines. Provide these records and a <br /> corrective action statement to the EHD within 30 days. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation #301 -Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION <br /> -Oil was observed on the top surface of one red damaged 55 gallon empty drum. <br /> -Oil was observed on top surface of one white 55 gallon drum containing used oil. <br /> -Oil was observed on top surface of one red 55 gallon drum with 5 used oil filters on top. <br /> -Oil was observed on the side of a white used oil filter container. The oil ran along the side of the container down to <br /> the shop floor. <br /> REGULATION GUIDANCE: A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment <br /> CORRECTIVE ACTION: Immediately clean all oil from the top surface of the three drums, the side of the oil filter <br /> container, and off the floor at the base of used filter container. Manage the waste according to Title 22 California <br /> Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San Joaquin <br /> County Environmental Health Department describing the storage and final disposition of the cleaned up waste. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation,.— <br /> Page <br /> iolation:Page 2 of 6 <br />
