Oily shop towels were observed in the secondary containment used to store two 55-gallon used oil drums(see <br /> photos IMG 0706, 0711).The facility does not have disposal records for the used shop towels.According to Cesar <br /> Davila, owner, he washes the used shop towels at his home to reuse them at his business. <br /> 2. Metal shavings were observed on a counter beneath a bench vice on the east side of the facility(IMG 0716). The <br /> facility does not have disposal records for the metal shavings.According to Cesar,these metal shavings were <br /> generated from cutting a pipe for a flag pole. Cesar stated that he does not resurface brake rotors at his business. <br /> 3.An unlabeled pail of paint,which had a rusted lid,was observed on the ground outside and on the west side of <br /> the facility(IMG 0719). Cesar stated that unless the paint belonged to the property owner, he would dispose of the <br /> paint at the San Joaquin County Household Hazardous Waste(HHW)facility. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste if <br /> the metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled <br /> as scrap metal. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for the oily rags, metal shavings, <br /> and paint and manage them according to Title 22 CCR. Use Safety Data Sheets (SDS),waste sampling and test <br /> results or other knowledge to support your hazardous waste determination. Waste testing must be done using <br /> methods specified in Title 22 CCR including sections 66261.20-24. Used/oily shop towels can be sent to a laundry <br /> service approved to handle this material. Keep the laundry receipts for three years. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
