UP-86-6, based upon the staff report findings. <br /> VARIANCE FINDINGS <br /> 1 . "Because of the special circumstances applicable to the pro- <br /> perty, including size, shape, topography, location, or <br /> surroundings, the strict application of the zoning regulation <br /> deprives the property of privileges enjoyed by other property <br /> in the vicinity and under identical zoning classification. " <br /> ° This finding cannot be made. Most buildings in the RR <br /> zone are restricted to a 35-foot height limit . The <br /> Planning Title increases the permissible height for quasi- <br /> public buildings - such as the sanctuary - to 75 feet . The <br /> requested 108-foot sanctuary height far exceeds that for <br /> which any previous Variance has been granted. It is the <br /> intensity of the use that requires such a tall sanctuary <br /> building. The church use could be established on a smaller <br /> scale with a sanctuary that conforms to the 75-foot height <br /> limitation. <br /> 2. The granting of the Variance will not constitute a grant of <br /> special privileges inconsistent with the limitations upon <br /> other properties in the vicinity and zone in which the pro- <br /> perty is situated. " <br /> This finding cannot be made. Other quasi-public uses in <br /> Morada conform to the height regulations of the Planning <br /> Title. No building height Variances have been approved in <br /> Morada. <br /> 3. "The Variance will not authorize a use or activity which is <br /> not otherwise expressly authorized by the zone regulation <br /> governing the parcel of property. " <br /> This finding can be made. Planning Title Section 9-5002 (e) <br /> permits the following uses, subject to Use Permit approval : <br /> "Churches, including customary accessory uses such as <br /> social and recreation facilities, construction of an exclu- <br /> sively religious nature, administration and minister' s <br /> residence. " <br />
