The following is an itemized list of hazardous waste violations that have not been <br /> addressed for DELGADO AUTO REPAIR as of March30, 2020. <br /> Open violations from December 06, 2019 inspection <br /> Violation#101 - Managed a hazardous waste without an identification number. <br /> OBSERVATION This business does not have a hazardous waste ID number in the California Department of Toxic <br /> Substances Control (DTSC) database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of, transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at https:Hdtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain a State ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#102 - Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS Oily absorbent and rags are thrown away into the trash. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately cease disposal of oily absorbent and rags into the trash. Make a hazardous <br /> waste determination for each waste and manage them according to Title 22 CCR. Use Safety Data Sheets (SDS), <br /> waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing <br /> must be done using methods specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
