ACTON MICKELSON ENVIRONMENTAL <br /> REMIDIATION OF MONITORING WELLS AT DET 2-8 APN 246-130-09 AND <br /> SYCAMORE VILLAGE 2 &3 AS SHOWN ON E11-0084 <br /> Acknowledged by applicant or its authorized representative or the contractor agree to <br /> comply with the following requirements: <br /> 1. Applicant or Its authorized representative(s) or the contractor and sub-contractor <br /> shall comply with all the requirements of Chapter 7.24 of the Tracy Municipal <br /> Code regarding dust control. The Applicant or its authorized representative(s) <br /> shall spray water on the construction site during windy and dry days, during or <br /> after completion of the construction operations or when required by the City to <br /> control dust. Applicant or its authorized representative(s)shall be responsible to <br /> clean and/or sweep at least twice a day or as required by the City, all streets that <br /> are affected by the construction operations or used by trucks or equipment on this <br /> work. <br /> 2. Applicant or its authorized representative(s) or the contractor and sub-contractor <br /> shall repair, replace or restore any Improvements whether private or public <br /> improvements to its condition prior to being damaged or better condition that are <br /> damaged by the Applicant or its authorized representative(s) or the contractor and <br /> sub-contractor as a result of the construction operations upon notification by the <br /> City, all at the Applicant or its authorized representative(s)'s costs.Applicant or its <br /> authorized representative(s)shall complete the work required under this section <br /> within the timeline specified by the City. No reimbursement from the City <br /> whatsoever will be granted. <br /> 3. Applicant or Its authorized representative(s) or the contractor and sub-contractor <br /> shall pay additional Inspection and testing fees, if necessary, as determined by <br /> the City, for the remaining portion of the work and/or for inspection services <br /> beyond normal working hours and for cost of inspection performed during <br /> weekends or holidays.Applicant or Its authorized representative(s)shall pay the <br /> additional Inspection fees upon written request and such payment shall be <br /> received by the City within ten calendar(10) days from date of written request. <br /> 4. Applicant or its authorized representatives) or the contractor and sub-contractor <br /> shall comply with the requirements of Regulation VIII, Fugitive PM 10 Prohibitions <br /> of the San Joaquin Valley Air Pollution Control. Cost of complying with this <br /> requirement shall be the sole responsibility of the Developer or Its authorized <br /> representative(s), <br /> 5. Applicant or its authorized representative(s) or the contractor and sub-contractor <br /> shall maintain insurance for the benefit of the City and such insurance coverage <br /> shall meet the Insurance requirements specified in Section 7.04,010(f) of the <br /> Tracy Municipal Code. City shall be named as additional insured in the original <br /> certificate of insurance. Renewal certificate shall be provided by the Developer or <br /> its authorized representative(s)to the City, prior to insurance expiration. <br />
