6. Applicant or its authorized representative(s) or the contractor and sub-contractor <br /> shall work with the City for any modification on the traffic control plan that Is <br /> necessary as determined by the City. Street closure will be allowed Incase of an <br /> emergency basis only. No trench shall be left open or uncovered and unprotected <br /> during the night. Appropriate signs and barricades shall be installed within the <br /> site and on all trenches during and after work hours. Developer or its authorized <br /> representative(s)shall be responsible for ensuring that work site is safe and <br /> secured with appropriate traffic signs at each end of the work day, Driveway(s)or <br /> access road(s)to private property(s)and/or'businesses shall be kept open at all <br /> times, <br /> 7. The Applicant or its authorized representative(s) or the contractor and sub- <br /> contractor shall be responsible for correcting or mitigating any damages on <br /> private properties and existing roadway improvements as a result of the <br /> construction operations. Applicant or its authorized representative(s) agreed to <br /> Indemnify, defend, and hold harmless the City(including its elected officials, <br /> officers, agents, and employees)from and against any and all claims, demands, <br /> damages, liabilities, costs, and expenses resulting from or arising out of the <br /> performance of the construction work by the Applicant or Its authorized <br /> representative(s) and/or their agents, representatives, Its authorized <br /> representative(s) or employees. <br /> 8. The applicant or Its authorized representative(s)or the contractor and sub- <br /> contractor shall be responsible for obtaining permission(s) or agreement(s) with <br /> affected property owner(s)for work to be done outside available City right-of-way <br /> and/or easement(s), all at the Developer's sole cost and expense. <br /> 9.) Applicant will provide the City Inspector complete daily work schedule before start <br /> of the work.
