Musco Olive Products and the Studley Company(Dischargers) are proposing to
settle the ACL Complaint for the full amount of$150,000 and waive their right to a hearing on the
matter. You have requested authorization to make three payments of$50,000; one payment due upon
execution of this agreement to settle, the second payment 90 days later, and the third payment 90 days
after the second payment.
Your request to settle the ACL Complaint in three payments is acceptable to the Regional Board.
Because you are proposing a payment schedule, a revised waiver form is necessary; that form is
attached. Please execute the revised waiver form and return it to this office no later than 29 May 2002
with your first payment of$50,000. Due dates for the second and third payments are included on the
revised waiver form. Please note that failure to pay the amounts by the dates specified in the revised
waiver will result in the full amount becoming due immediately, and may result in further enforcement
action including, but not limited to,referral of the matter to the Attorney General for resolution.
If you have any questions regarding this ACL Complaint settlement, please telephone Tim O'Brien at
(916) 255-3116.
Lw4s P
THOMAS R.
