(1) It is a liquid, other than an <br />aqueous solution containing less than 24 <br />percent alcohol by volume and has flash <br />point less than 6000 (1400F), ,is deter- <br />mined by a Pensky-Martens Close Cup <br />Tester, using the test method specified <br />in ASTM Standard D-93-79 D-93-80 <br />(incorporated by reference, ser 260.3.1), <br />or a Setaflash Closed Cup Testor, using <br />the test method specified in .ASTM <br />Standard D-3278-78 (incorpointed by <br />reference, see 260.11), or as dot ermined <br />by an equivalent test method apj)Txowed by <br />the Administrator under procedures set <br />forth in 260.20 and 260.21. <br />(2) It is not a liquid and ins capable <br />under standard temperature and pressure, <br />of causing fire through friction, <br />absorption of moisture or spontaneous <br />chemical changes and, when ignited, <br />burns so vigorously and persistently <br />that is creates a hazard. <br />(3) It is an ignitable compressed gas as <br />defined in 49 CFR 173.300 and as deter- <br />mined by the test methods described in <br />that regulation or equivalent test <br />methods approved by the Administrator <br />under 260.20 and 260.21. <br />(4 ) It is an oxidizer as def inrd in 49 <br />CFR 173.151. <br />(b) A solid waste <br />characterization of <br />not listed as a <br />Subpart D, has the <br />Number of D001. <br />that exhit)its: the <br />ignitabil.i.t-y . but is <br />hazardous �.-aste in <br />EPA Hazardous Waste <br />(45 FR 33119, May 19, 1980, as amended <br />-at 46 FR 35247, July 7, 1981] <br />For the Cal Cedar fly ash, the extinguish temE»rature of the ash <br />was determined to be 850C and 690C for samples Bin 1 and Bin 2 <br />respectively: The extinguish temperature is that temperature at <br />which vapor is given off from the substance. The ash did not <br />flash, therefore the flash point is significantly higher than <br />these temperatures. Therefore, the fly ash would not be <br />classified as hazardous by this characteristic. <br />
